The regional court will have to decide again in the case. Sögel was released from prison in Stráž pod Ralskem and was not remanded in custody. The vibrator cost 499 Czech crowns (less than 20 euros). According to the indictment, the man took him last April at the DM drugstore in Frenštát pod Radhoštěm, shoved him under his jacket and left without paying.

Because he stole at a time when the coronavirus pandemic was in an emergency, he was facing a higher sentence than under normal circumstances. The rate ranged from two to eight years at the time of the emergency. According to the newspaper, Sögel has 23 entries in the register and does not have a permanent residence.

The Supreme Court has already abolished several similar sentences for petty thefts, for which people received higher sentences in view of the state of emergency. One of them was, for example, a man who was to go to prison for a year and a half for stealing five buns. The court already concluded at that time that not every theft in an emergency should be punished more severely. If its implementation and other circumstances are not related to an emergency situation, normal penalties may be imposed according to him.
