He Grain and Food Trade Association (GAFTA) Court of Appeal based in London, United Kingdom, ratified the initial award and dismissed the claim presented by Duron LLC against the state Food Production Support Company (Emapa) for more than $8 million. This information was confirmed by the State Attorney General’s Office (PGE) of Bolivia.
The conflict arose as a result of an alleged breach of contract alleged by Duron in relation to a contract with Emapa for the purchase of 30 tons of wheat.
The company Duro filed a series of claims in 2021leading the Arbitration Court to issue a final award on December 22, 2022, which completely rejected the company’s claims.
Duron appealed this decision in March 2023, but the recent Court of Appeal ruling, issued on October 3, 2024, confirmed the Final Award and again dismissed all of Duron’s claims, also ordering that the company cover the administrative costs of the appeal process.
This result, according to the official PGE bulletin, is considered “a resounding victory” which reaffirms the commitment of the Bolivian government in defending the interests of the Plurinational State and its institutions.
