On January 29, a man who will turn 65 next week was the subject of an immediate appearance before the Criminal Court of Saint Nazaire (Loire-Atlantique), for harassing his ex-partner between January 4 and 24, 2021.
Requesting a dismissal to prepare his defense, he was placed in custody until Thursday March 11, date of the trial. Judge, he did not go back to prison.
In September 2019, after years of loneliness, the 60-year-old meets a friend who has a house in Corsept. The couple live there together for seven months.
In August 2020, the companion wishes to end this relationship, due to the sexagenarian’s dependence onalcohol. “He drinks a lot, especially whiskey, hides his bottles all over the place,” she said. Absent at the hearing, she asked nothing.
144 messages
The ex-companion had already come forward in November 2020, to the gendarmes for malicious calls, which earned the sexagenarian a conviction which he appealed.
On December 30, he was already tried in immediate appearance for identical facts and sentenced to twelve months in prison with probationary suspension, and a ban on all contact with his ex. The first SMS… he sent it on January 5th. Thursday 11, at the bar, the defendant, calm, calm, highlighted “the feeling of love” he feels for this woman.
Moreover, the 144 messages sent during the 20 days of January are practically all love messages, apart from perhaps the very first ones that mention his move. The victim’s three responses are all the same: “You don’t have the right to contact me!” “
Day and night
But the string of contacts at any time of the day or at the end of the evening disturbs the complainant.
The president, Cecile Capeau, and the prosecutor, Maggy Moreau, reported 29 messages between 5:35 p.m. and midnight one day, for the first; 23 messages between half past twelve and 11:45 p.m. for the second.
The prosecutor judging that the man feels more sorry for himself than on that of the victim.
The “very sensitive” defendant confesses: “I can imagine that she could have been destabilized, yet that was not my goal, I did not think of harming her and then I would have liked to put the pieces back together! “
Recognizing that he has had drinking problems since retiring in 2018, this former police officer insists: “This time, I understood. “
His lawyer, Me Florance, realizes that the messages, even of love, could have “annoyed a victim who however at no time did not specify that his living conditions were altered”, asking the court not to follow the request for continued detention of the parquet.
She is heard. The sexagenarian is condemned to two months in prison and, of the twelve probationary stays pronounced on December 30, three are revoked.
