Hello, I came home today and had the cancellation of my loan in the mailbox. I was late on two installments and then contacted the bank. They agreed with me to defer payment for four months. The payment date is always the last day of the month. Unfortunately I had it on the 3rd
01.10. first transferred, this would be the first installment included with the current one. On October 2nd the notice of termination was advertised. Can I defend myself against this?

Defend? No. You didn’t keep the agreement.
At best, you can ask whether the bank will take back the notice. But I wouldn’t expect it. This is usually an automated process and just goes its own way.
After termination, the debt is usually collected by a debt collection agency. You can probably agree with them to pay in installments (against horror fees).
Is there any chance that you can repay this loan? If you are fundamentally over-indebted, it would probably make more sense to address the entire situation.

The loan has always been paid. It’s just been a little difficult the last few months. I also paid the installment. And I also signed a deferment agreement with the bank because I want to pay it. It’s not about an extreme sum either. There are still €6000 outstanding.

But this results in a negative Schufa entry. That would of course be very inconvenient. We still have credit on our house.

Yes, but the bank has already accommodated you and deferred payment. And you didn’t stick to that agreement either. So it is clear that the bank is terminating the contract.

Unfortunately, I think you’re dwelling on trivialities. The fact is that you didn’t stick to the new appointment. And the deferral was certainly concluded under the premise that the entire amount would be due if you defaulted.
The fact that they write that you ignored three reminders is really irrelevant – and in my opinion you probably won’t be able to defend yourself against it.

No, this was actually not written or said. I also checked this again in the new payment agreement. I mean, we’re talking about one day and I transferred this in real time. Either way, I have to call them Monday and hear what they say.

I only have one question, should it really be the case that the termination remains in effect. Do you generally always get a negative Schufa entry? And does this have an impact on my home loan, for example? So even if you can pay back the entire amount?
