Litigation over Accendo paralyzes payments to creditors

Mexico City. The various lawsuits initiated against the judgment of recognition, graduation and priority of credits, as part of the liquidation process of the Accendo bank, have forced payment to recognized creditors to be suspended, due to the fact that the protections and revocation appeals presented by some of the parties could modify what has been resolved so far in court.

“It is not possible to make payment to recognized creditors until said ruling has become final once the aforementioned challenges are resolved, as well as the asset recovery process is concluded,” stated the Institute for the Protection of Bank Savings. (IPAB).

Until now, Accendo’s recognized debt with 407 creditors reaches 5,840 million pesos. Given that the bank’s business was mainly with government entities, the obligations with the latter alone reach 3 thousand 24 million pesos. This money cannot be refunded until the protections and appeals for revocation against the sentence known so far are concluded.

Among the government creditors who were direct savers of Accendo are the Ministry of Public Finance of Hidalgo, with 807 million 128 thousand 784 pesos; the government of Puebla with 604 million 996 thousand 132; Veracruz Health Services with 357 million 900 thousand 207; the municipalities of Tlalnepantla (in the State of Mexico) and Zapopan (in Jalisco) with 315 million 648 thousand 265 and 303 million 953 thousand 21 pesos, respectively.

Tamaulipas follows with 179 million 534 thousand 573 pesos; the State of Mexico with 112 million 425 thousand 554; Durango with 57 million 293 thousand 218; Hidalgo Health Services with 56 million 647 thousand 237; the National Lottery with 51 million 333 thousand 880; Baja California with 51 million 279 thousand 328 and the municipality of Puerto Morelos (in Quintana Roo) with 4 million 362 thousand 113 pesos.

On September 9, 2021, the Undersecretary of the Treasury, Gabriel Yorio González, reported the license revocation of Accendo Banco due to non-compliance in terms of capital and liquidity. On September 28, the IPAB Governing Board authorized the payment of guaranteed obligations (POG) to the savers of said entity in terms of the deposit insurance guarantee, up to 400 thousand investment units. On the date the liquidation process began, this support was equivalent to 2.76 million pesos.

“The POG concluded within the deadlines determined by the regulation, and Accendo savers collected 99.16 percent of the amount of their deposits. The total amount paid by the IPAB to savers amounts to 1,314 million pesos,” the organization detailed in a statement. He stated that he is also a creditor of the bank in liquidation, because the collection rights were subrogated, after payment to part of the savers.
