Listening Again to the Rows of Considerations Judges Sentenced to Death to Ferdy Sambo

TEMPO.CO, Jakarta – Defendant in the Murder Case of Brigadier Nofriansyah Yosua Hutabarat alias Brigadier J, Freddy Sambo, was sentenced to death by the panel of judges at the South Jakarta District Court. Reaping the pros and cons, what were the judges’ considerations in sentencing the former two-star police general?

Overview of the Sambo Verdict Trial

Quoting from Tempo, the panel of judges at the South Jakarta District Court sentenced Ferdy Sambo to death in a sentencing hearing that took place on Monday, February 13, 2023. The panel of judges chaired by Wahyu Iman Santoso believes the former two-star general was the mastermind behind the premeditated murder of his aide, Nofriansah Yosua Hutabarat or Brigadier Joshua.

The murder occurred at Ferdy’s official residence, at the Duren Tiga Police Complex, Pancoran, South Jakarta, July 8 2022. Initially, the police said that Yosua’s death was caused by a shootout with another aide, Bharada Richard Eliezer Pudihang Lumiu. Later it was discovered that the story was just a fabrication by Sambo to cover up his role in the premeditated murder. Sambo is believed to be the mastermind as well as the person who shot Joshua.

Row of Judges’ Considerations

During the sentencing hearing that was served by Ferdy Sambo, the Judge considered that there was nothing mitigating for the former Head of the Professional and Security Division or Propam Polri.

“Sented Ferdy Sambo as a death sentence,” said Head of the Panel of Judges Wahyu Iman Santoso when reading out the verdict, Monday, February 13, 2023.

Wahyu mentioned seven things that aggravated Ferdy Sambo’s sentence. Excerpted from Tempo, some of these considerations include:

1. The panel of judges stated that the defendant’s actions were committed against his own adjutant who had served for three years.

2. The defendant’s actions caused deep sorrow for the family of Brigadier Joshua.

3. The defendant’s actions caused uproar in the community.

4. Not behavior that is appropriate for law enforcers “Fourth, the defendant’s actions were inappropriate in his position as a law enforcement officer, in this case Kadiv Propam,” said Judge Wahyu.

5. The defendant’s actions have tarnished the Polri institution in the eyes of Indonesia and the world.

6. The actions of the defendant caused other Polri members to become involved.

7. The defendant was buying and selling and did not admit his actions.

This sentence is heavier than the demands of the public prosecutor. Previously, on January 17, the public prosecutor demanded that Ferdy Sambo be sentenced to life in prison because he was believed to have violated Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 1 of the Criminal Code concerning premeditated murder.
