«CERTAINTY OF THE PUNISHMENT»
«Three considerations must be made regarding the sentence to be inflicted on Turetta – explained the lawyer – The first is that the sentence must be fair and must take into account all the components of the evaluation of the accused. The defense’s task is therefore to evaluate all the objective elements of the case and not to evaluate the case on an emotional level. Second consideration is the issue of life imprisonment, discussed in the indictment by Turetta’s defense just as the death penalty was discussed in Beccaria’s time. The last related consideration is that the punishment must be certain. For some reward trials introduced by the State, the sentence is shortened for the convicted person, who never serves the full sentence foreseen by the judge who imposed the sentence. In my opinion the convicted person must serve his sentence in full, but this does not happen and in fact citizens have the feeling that there is no certainty of the sentence. When the condemned man has paid his debt, however, he must be able to reintegrate into society.”
