Freiburg (dpa / lsw) – Because he shot his ex-girlfriend’s partner, a 30-year-old has been sentenced to life imprisonment. The jury chamber of the Freiburg district court ruled on Tuesday that it was a targeted shot in the victim’s chest.
The crime happened in January on the street in front of the woman’s apartment in Freiburg. The victim, a 31-year-old man, died in a hospital shortly thereafter. (Az: 1 Ks 200 Js 663/23).
A possible preventive detention of the accused is to be examined at a later date. This is one of the toughest measures in criminal law. A perpetrator can remain in state custody even if he has already served his sentence. “Things like this should never happen again,” presiding judge Arne Wiemann warned in the verdict.
The defendant’s lawyer announced after the verdict that he wanted to appeal. The prosecution had initially only accused the 30-year-old of manslaughter.
The last day of the trial took place under massive security precautions, with around 20 police officers present in the hall alone. The defendant, who is being held in custody, was wheeled into the courtroom in a wheelchair – he was handcuffed and had his feet shackled. When the verdict was announced, there was applause in the hall. “We’re not at a carnival here,” said the presiding judge.
The accused, a German, wanted to give a present to his eight-year-old daughter, who does not live with him. The girl was accompanied by her mother’s partner. The accused had hidden a revolver with him, which he suddenly drew without being attacked beforehand. Before the crime, there had already been arguments between the two men.
The court concluded that the defendant spontaneously decided to kill the 31-year-old. “We assumed full culpability,” said Wiemann. He advised the accused to do social therapy.
The accused then left the crime scene after the shot. According to earlier police reports, he was arrested without resistance after his escape. A relative had previously announced by emergency call that the man wanted to turn himself in. The murder weapon was later found in a bush near the place of arrest, the police reported.
