Legal Protections for Psychiatric Patients: Punishments for Insult and Mistreatment

The Psychiatric Patient Care Law specifies guarantees to protect the psychiatric patient if he is exposed to insult or mistreatment. In this regard, Article 46 stipulates that he shall be punished by imprisonment for a period not exceeding 6 months and a fine not exceeding 3,000 pounds, or by one of these two penalties:

1. Anyone who intentionally enables a person subject to compulsory entry or treatment procedures to escape, or assists him in doing so, or hides him by himself or through someone else, with his knowledge of this.

2. Anyone who prevents the inspection authorized by the National Council for Mental Health, the Regional Council for Mental Health, or anyone delegated for this purpose in accordance with the provisions of this law.

3. Anyone who refuses to give information needed by the National Council for Mental Health, the Regional Council for Mental Health, or its inspectors in performing their mission, or gives information that is contrary to the truth, while knowing this.

4. Anyone who falsely informs a competent authority, with bad intent, against a person that he suffers from a mental illness stipulated in the provisions of this law.

Article 47 also stipulates that “anyone who is charged with guarding, nursing, or treating a person suffering from a mental illness and mistreats or neglects him in a way that would cause him pain or harm shall be punished with imprisonment for a period not exceeding one year and a fine not exceeding 5,000 pounds, or one of these two penalties.” If the mistreatment results in illness, injury, or disability in the patient’s body, the penalty shall be imprisonment for a period not exceeding three years.”
