The summons must be handed over to the person liable for military service in person and under signature.
Lawyer Roman Simutin spoke about the stages of delivery agenda in Ukraine during mobilization.
On his YouTube channel, he explainedwhich way the agenda goes from the TCC to the military person.
“Representatives of the territorial recruitment centers must introduce themselves, show documents confirming that these people have the right to issue summonses,” the lawyer said.
Steps for issuing a summons:
- an order of the head of the TCC is issued and signed with a list of persons, for example, called to update credentials;
- a summons is issued for a specific person indicating the number of this order and signed by the head who prints;
- an order of the head of the TCC is formed and signed for authorized representatives of the TCC who have the right to serve the agenda;
- the summons is handed over personally under the signature of the called person.
“What are the stages in reality? First, they stamped unfilled summonses with the signature and seal of the head of the TCC. Second, they handed them over to everyone who could and sent them on a raid. Third, they caught a person, “torn out” documents, filled out the summons “on their knees” and They gave 48 hours to arrive at the TCC. Or the fourth one was brought to the TCC,” the lawyer explained today’s realities of serving the summonses.
Simutin stressed that due to a violation of the procedure for serving summonses, a refusal to receive them would not be an evasion of mobilization.
Recall men, in addition to the agenda, can be given notices. The lawyer explained what kind of document it was and whether it had legal force.
On April 7, the Cabinet of Ministers adopted a resolution according to which TCCs can now send summons to persons liable for military service, regardless of their place of stay on military records.
