State Legal System Expert Bivitri Susanti highlighted the statement Joko Widodo (Jokowi) which mentions the president can campaign and favor. Bivitri assessed that now the politics of the country is no longer a happy democracy.
This was conveyed by Bivitri in the discussion “Rigged Elections Question the President’s Neutrality to the Ministry of Defense’s Report to Bawaslu” in Tebet, South Jakarta. He said that now people feel anxious and afraid.
“We are currently filled with fear, actually what was created was, this is called a democratic party, a happy election, no you know. I’m not happy, I’m anxious and sometimes afraid too and that’s what was created,” said Bivitri at an event held by PBHI , Jakarta, Thursday (25/1/2024).

Bivitri said he often debated articles with parties who didn’t believe him. He said that his party was fighting for democracy in Indonesia.
“Because often when I debate an article, I am actually invited to fight. So for me, this is not a happy, fun election, but we are fighting for democracy. That’s why I want to say that we have to fight for this really seriously,” he said.
Meanwhile, he said that Article 299 of the Election Law cannot be used as an excuse for the president to campaign and take sides. He said the public must read an article in its entirety, not just one verse.
“It’s true, friends, Article 299 Paragraph 1, the President and Vice President have the right to carry out a campaign. But, in my notes, (there are) two. First, please read the whole article, not just one paragraph. If friends Friends, read to the bottom, that’s one,” said Bivitri.
He said the provisions of this article were made for incumbent presidential candidates while Jokowi is currently not from that category. He said Jokowi could carry out a campaign if he had the same party as the one he was supporting.
“And then look, secondly, look at it and look at the construction of the law, we will see that article 299 is actually for its purpose, it was created for the incumbent president to campaign,” said Bivitri.
“So when Jokowi 2019, he needed that article, indeed he had the right. SBY 2009, when people were running continuously, they were not allowed to campaign, that’s why that article was made. That’s the point, what is the proof? Try it, friends, you can see later, if you can open the law, invite it “The law is very thick, very thick, friends. But we can see that Article 299 itself, paragraphs 2 and 3, are clear,” he continued.
