Legal Department Urges Supreme Court to Reject Opposition’s Action on ISSSTE Law Reform

MEXICO.- The Legal Department of the Federal Executive (CJEF) made a call to the Supreme Court of Justice of the Nation (SCJN) so that it does not support the action of unconstitutionality presented by the opposition in the Senate.

This action is directed against various parts of the ISSSTE Law, which were approved by the Morena party and its allies during the event known as “Black Friday.” The CJEF warned that taking this action would have negative consequences for the rights of numerous state employees.

In a statement, the federal agency He pointed out that the legislative modification establishes several options to solve “the serious problem” of indebtedness of workers at the service of the State for mortgage loans.

He affirmed that with the new reforms to the ISSSTE Law, it seeks to free pensioners over 60 years of age from the mortgage debt that they have acquired more than 30 years ago.

If the claim of the minority group of senators for the SCJN to invalidate the decree reforming various provisions of the Law of the Institute for Social Security and Services of State Workers (ISSSTE Law) is accepted, it will affect the rights of thousands of workers in the service of the state.

The CJEF urges the ministers of the SCJN to consider the damage that would be caused to the beneficiaries if the reform of the ISSSTE Law is declared invalid due to a boycott ploy by a legislative minority that only has the intended to paralyze the constitutional functions of the Senate of the Republic”.

The Ministry argued that in the event of declaring the invalidity of the contested regulations, The public policies promoted by the Government of Mexico through the ISSSTE Housing Fund, such as the “60/30” program, would be eliminated. (60 years of age or older and 30 years or more of covering the mortgage loan or those who have already covered more than twice the original amount of the mortgage), which, he indicated, has already benefited 16,000 people and is expected to benefit three one thousand more pensioners, with an authorized budget ceiling of one thousand 700 million pesos.

He pointed out that in addition to approving the opposition’s demand, the implementation of more programs for the benefit of workers in the service of the State would be prevented, such as the restructuring of debts acquired in the Measurement and Update Unit (UMA) to transfer them to pesos, which would benefit approximately 23,000 people, and the possible release of mortgage loans in favor of another 5,000 beneficiaries of the reform.

“Opposition lacks legitimacy”

The CJEF stated that the senators who file the unconstitutionality action lack “legitimacy” to claim the invalidity of the reform, since it accused them of opposing the parliamentary debate.
