The car was flashed in the middle of the day, south of Lyon, at 88 km/h retained instead of the 70 km/h authorized. The report, drawn up in August 2021, was sent to the owner of the vehicle. Except that she refuses to pay it: she explains that she sold the Peugeot 206 in 2020 to a mechanic who wanted to fix it.
In April 2023, the story is still not settled. She is even sent back to the Thionville police court. Because the former owner, originally from Bertrange, uses all means to contest the fine. She opposed the penal order (simplified legal procedure for minor offenses and misdemeanors) issued against her in May 2022.
The sale is not in the nails: fine imposed
The defendant produced a transfer certificate, a cerfa form, downloaded from the internet and completed when selling the car. But the gray card has not been crossed out. The declaration of transfer of the vehicle was not registered in the prefecture. The alleged buyer says he doesn’t know her.
“You are not in a position to prove to us the existence of the new owner”, indicates to him the deputy commissioner of Thionville, officer of the public prosecutor during the hearings of the police court. “I thought that the mechanic had to manage these declarations”, defends the defendant. “If necessary, I will assume,” she continues. The negligence earned him a conviction. She is liable for a fine of €150.
