Legal and arbitrary violations of the 2023 electoral process – PublicoGT

I am writing to express my deep concern about the legal abuse of prosecutor Curruchiche and Judge Orellana. These two officials have been working to prevent the second ballot from taking place, which is totally unconstitutional.
Article 205 of the Guatemalan Constitution establishes that “the President of the Republic shall be elected by universal, direct and secret suffrage.” Article 206 establishes that “the constitutional period of the President of the Republic will be four years.”

Article 207 establishes that “in the event of a tie in the presidential election, a ballot will be held between the two candidates who have obtained the highest number of votes.”

Prosecutor Curruchiche and Judge Orellana are trying to prevent the balloting from taking place, arguing spurious situations. However, there is no evidence to support their claims. On the contrary, there is evidence to show that the June 25 election was free and fair.

The prosecutor and the judge are also trying to prevent the balloting from taking place, both of whom are acting for political reasons. They are trying to prevent the balloting from taking place on August 20, as established by the Supreme Electoral Tribunal.

The legal abuse of the prosecutor and the judge is a threat to democracy in Guatemala. It is urgent to take measures to protect the Constitution and guarantee that the ballot is held as established by the Political Constitution of Guatemala, through the Supreme Electoral Tribunal TSE, if necessary we must take to the streets in protest against so much legal abuse.
