Lee Jae-myung’s ‘Perjury Teacher’ Case: Court to Decide on Merger with Other Trials

The court will decide on the 13th at the earliest whether to merge Democratic Party leader Lee Jae-myeong’s ‘perjury teacher’ case with the ‘Daejang-dong/Wirye New Town corruption’, ‘Seongnam FC illegal donations’, and ‘Baekhyeon-dong preferential development’ trials.

According to the legal community on the 6th, the Seoul Central District Court’s Criminal Agreement Division 33 (Presiding Judge Kim Dong-hyun) set the trial preparation date for Representative Lee’s perjury teacher case at 2 p.m. on the 13th.

Chief Judge Kim Dong-hyeon said at the Daejang-dong trial on the 3rd, “We will hold a trial preparation date next time to determine whether to merge the perjury teachers and make the final (conclusion) known at that time.” The decision on whether to merge will be made about a month after the perjury teacher case was assigned to the court on the 17th of last month.

The perjury teacher case is that Representative Lee asked a witness, Mr. Kim, to give false testimony during the trial on charges of publishing false information at a broadcast debate for the 2018 Gyeonggi gubernatorial election. Previously, Representative Lee was fined 1.5 million won for impersonating a prosecutor by calling then Seongnam Mayor Kim Byeong-ryang while covering the ‘Suspicion of preferential treatment at Baekgung Park View in Bundang’ in 2002. However, Representative Lee was indicted on charges of violating the election law after saying during the debate, “I did not impersonate a prosecutor and was falsely accused,” and on the 16th of last month, he was indicted on charges of instigating perjury during the trial in this case.

Representative Lee’s side requested that the perjury teacher be merged into the Daejangdong and other trials, but the prosecution’s position is that they should be tried separately. If the perjury teacher case, which has a relatively simple structure, is merged with complex cases such as Daejang-dong and Baekhyeon-dong, there is a high possibility that the first trial sentencing will be delayed.

In the legal community, there are criticisms regarding Representative Lee’s request for a merger, such as “an attempt to delay the trial with political intent.” A former chief prosecutor and lawyer said, “Representative Lee appears to be trying to delay a conviction until the next presidential election.”
