However, Lee Dong-guk and his wife submitted a request for adjustment of damages worth 1.2 billion won to the Incheon District Court in October last year against Mr. B on the grounds that he used the fact of childbirth for publicity without obtaining consent.
According to the mediation application, Lee Dong-guk and his wife “posted (the photo) on the Internet without permission even after providing proof of contents requesting to stop using the photo,” and “they are responsible for damages worth 1.2 billion won, which is equivalent to family modeling fees.” reported.

However, Mr. B’s position is, “Most of the infringements on portrait rights occurred when Mr. C, the former director, was running the hospital, and Mr. B just left the promotional picture frame hanging when he took over the hospital.” In addition, he claimed that the time when he filed the complaint was when a dispute regarding the lease arose between Mr. B and the son of Mr. C, who had transferred the hospital, and that they were trying to pressure him for ‘infringement of portrait rights’. The complaint also states, “Despite the fact that the complainant took over the hospital after February 2019 and did not operate the hospital before, he submitted an application for mediation to the Incheon District Court with content that clearly contradicts objective facts.”
