The vacuum defies the fundamental law

The remark of BSP chairman Kornelia Ninova that she will hold the mandate until September 10-15 under the obvious circumstances that a government within the framework of the 46th parliament cannot be formed with the third mandate was qualified by constitutionalists as “party abuse”.

“Trud” sought the opinions of lawyers who united around the thesis that “the procedure under Art. 99 of the Constitution has a clear logic and purpose – it is the formation of a government or, if such is impossible – a quick way out of the political crisis. That’s why everything is accelerated in the third procedure”.

“The seven-day deadline is also explicitly stated, in which not only must a candidate for prime minister be broadcast, but also the composition and structure of the Council of Ministers must be proposed to the president”, the constitutionalists also commented on the strange situation with the delay of the third mandate.

According to representatives of parliamentary groups, purely political reasons impose a thesis that has nothing to do with Art. 99, and it is that the seven-day period was for the broadcast of a candidate for Prime Minister, and then the relevant parliamentary group could prolong the procedure as much as it considered.

Members of the Executive Bureau of the BSP succinctly explained to “Trud” that the current delay came at the request of representatives from the presidential institution. And the goal is acceptance of the budget update. On the other hand, however, precisely the lawyers of the BSP, as well as experts from “Dondukov” 2, made it clear that “such a vacuum and such procrastination contradicts the logic of the Constitution”.

Separately, “Positano” 20 are worried that the meeting of the National Council of the BSP, which is supposed to be scheduled for Thursday, may turn out to be pointless. Today, Ninova held talks with representatives of the Confederation of the Bulgarian Tourist Business and the Alliance of the Tourist Industry in Bulgaria and with the police union. On Tuesday and Wednesday are the talks on forming a cabinet with DB and ITN. If the two formations say “no” to form a government, as expected, then the socialists will have nothing to talk about at the plenum on Thursday.

Again, according to experts, it is quite reasonable for the BSP to follow Decision 20/1992 of the Constitutional Court, which states: “to seek and find a way to form a stable coalition”. “Furthermore, para. 3 of Art. 99 of the Constitution provides an answer to one more question: whether the candidate for Prime Minister is obliged to propose the composition of the government. According to the express order of the Constitution, within a 7-day period, the candidate for Prime Minister is obliged to propose to the President the composition of the Council of Ministers”, it is also written in the interpretation of the Constitutional Court.

Art. 99.

(1) The President, after consultation with the parliamentary groups, assigns a candidate for Prime Minister, nominated by the largest parliamentary group, to form a government.
(2) When, within a 7-day period, the candidate for Prime Minister fails to propose a composition to the Council of Ministers, the President assigns this to a candidate for Prime Minister named by the second largest parliamentary group.
(3) If, even in this case, the composition of the Council of Ministers is not proposed, the President, within the period under the preceding paragraph, assigns a subsequent parliamentary group to nominate a candidate for Prime Minister.
