Lawyer to be Tried for Fraud, Forgery and Professional Disloyalty in Lugo Court

The Provincial Court of Lugo will try next Wednesday a lawyer who hid information and deceived an imprisoned client and his sisters, going so far as to falsify two orders from the Constitutional Court to make them pay an alleged bail that did not exist.

The facts date back to 2017, when one of the clients of the prosecuted lawyer entered prison for a crime of sexual abuse. Since then and during the following months, the lawyer maintained contact with both the prisoner and his two sisters to express his intention to file “the appropriate resources” to achieve his release.

The defendant told the injured parties that the appropriate way was to file an appeal for review, but “they had to wait for the resolution of an appeal for amparo before the constitutional Court which was in process”.

According to the prosecutionthis he did knowing that the Tribunal had rejected this appeal months before and, in fact, the lawyer never carried out the procedures to file the compromised appeal for review.

During the months of February and April 2018, the defendant convinced his clients to pay him 2,500 euros as a deposit that, according to what he told them, had been imposed by the constitutional Court for the release of his client.

He or someone close to him prepared “a document that pretended to be a copy of an order from the constitutional Court“, in which that alleged bail was collected.

After receiving the money from his client’s sisters, the lawyer argued that the delay in the man’s release was due “to the strike of justice officials.” Subsequently, he gave them another false document in which another 1,000 euros of bail was claimed, although this amount was never delivered.

He Public ministry considers these facts as constituting a crime of professional disloyalty, another of fraud and a third crime of forgery in a private document. For the first of them, he requests a fine of 7,200 euros, while for the other two he claims six years in prison and a fine of more than 3,000 euros. He also requests compensation of 2,500 euros for those injured.
