A lawyer accused of appropriating 3,000 euros that his client paid him to pay a sentence that had been imposed on him for a crime of injury has accepted two years in prison, in the trial set for this Tuesday in the first section of the Hearing Province of A Coruña.
It has done so after an agreement between the Prosecutor’s Office, the defense and the private prosecution when the accused acknowledged the facts and agreed to a reduction in the sentence, which the man accepted after apologizing “sincerely” to the injured party “and, especially, to his mother”.
Initially, the Public Ministry requested a total of six years and 11 months in prison. After the agreement reached, the convicted person has accepted one year in prison for the crime of fraud and six months for each crime of documentary falsification, in public and private. He will also have to pay compensation to the victim of 35,094.94.
According to the Public Prosecutor’s Office in its letter, the client of this lawyer had been sentenced in 2011 as the perpetrator of a crime of injuries to a prison sentence of 21 months and, among other issues, to pay compensation of more than 10,700 euros.
FACTS
The lawyer, and defendant in this case, deceived the man and told him that after having negotiated with the private prosecution, instead of installment payments of 150 euros per month, he would accept a single payment of 3,000 euros and would forgive him the rest.
The complainant paid his lawyer the aforementioned amount and he prepared an ordering procedure of the Criminal Court number 1 of A Coruña, “which lacked all authenticity as it was not part of the Justice Administration”, in which the court recognized that the prisoner had paid the amount and definitively suspended the sentence.
In 2017, the lawyer presented a document to the victim “with the purpose of deceiving him and knowing that it could lead to the immediate imprisonment of his own client.” In said report, the defendant or someone under his command simulated the signature of the creditor in the final, where he acknowledged having received 3,000 euros “without having anything to claim from him for any other reason for the aforementioned document.”
