Lawyer: “Scheduling a trial for Marcel Hernández until 2024 is ungrateful and inhuman”

Raimundo Pérez, lawyer for soccer player Marcel Hernández, considers that scheduling the trial against the Alajuelense player until 2024 is “ungrateful, inhuman and rude.”

The Gender Unit of the Cartago Deputy Prosecutor’s Office confirmed that the trial against Hernández was scheduled by the Criminal Court for April 29 and 30, 2024.

“This is an ungrateful, rude and inhumane statement because they schedule a trial in the same process that has not been short, because at the end of October it will be three years old and the trial will be three years from now. The most serious thing is that Marcel has precautionary measures that harm him personally and professionally and, despite the fact that he has demonstrated his attachment to the process, it is an injustice, ”said Pérez.

During all this time of criminal proceedings, the player has not been able to go to Cuba to see his family, he has lost “a dozen opportunities” to play abroad and, the most unfortunate thing for his lawyer, is that the forward is arriving at the end of his career.

“We are clear in the defense what we have and he is going to be acquitted. Marcel wants a trial soon because this affects him a lot. We respectfully propose a reconsideration to the court, explaining the situation, but if the change does not prosper, we would have to go to the Constitutional Chamber ”, commented the lawyer.

The trial could take three days, since it will only have three technical witnesses, the statement of the victim and her mother.

For the lawyer, “Marcel what he wants is that the precautionary measures be lifted and that after that the trial will point it out in 2030 if they want, since that would give him the opportunity to go play abroad.”

“Last Thursday we received the news of the trial and I had to console him because he did not expect it and what is happening in the Judicial Power of this country is regrettable,” added Raimundo Pérez.

Hernández will face justice for four alleged crimes of rape against a minor, a neighbor of Cartago.

According to the accusation, the events attributed to him would have occurred in August 2018, when the victim was 16 years old. The Cuban was arrested on October 4 of that same year, after the victim filed a complaint against him.

In this case, Marcel was dismissed on two occasions, but after an appeal the opening of the trial was ruled.
