Pablo Gutiérrez, lawyer for former Police General René Sanabria, said that although his client served a sentence in the United States for the crime of conspiracy, he cannot be tried in Bolivia for drug trafficking because it is the same fact.
“There may be 20 or 50 criminal offenses, but when the fact is the same and it has been tried for that fact, an investigation cannot be opened, even less when the crime has been committed outside of Bolivian territory,” he told Radio Fides.
He also said that his client was arrested and illegally sent to jail on Wednesday when he arrived in Bolivia after being expelled from the United States.
“He has asked me to activate all the legal mechanisms to defend himself. He wants to know the accusation, he wants to testify, they have never summoned him to testify, ”he said.
Sanabria was accused of having provided protection to traffickers in 2010 for the export of 144 kilograms of cocaine. In September 2011, a judge sentenced him to 14 years in prison, of which he served nine.
