After learning this Sunday that the Plurinational Constitution Court revoked the decision of a Santa Cruz Guarantee Court that ordered the works to return to Santa Cruz, the lawyer for three of the accused from Banco Fassil, Samuel Durán, confirmed this situation and clarified that The detainees will remain in the capital of Santa Cruz.

Durán explained that in principle a court in La Paz declared the request of the Ministry of Justice founded, for the accumulation of cases due to connection and that the proceedings be sent to La Paz. It was thus that the court that had the case in Santa Cruz, as well as The Prosecutor’s Office has already sent the documents to the Government headquarters.

He also explained that The TCP resolution does not imply that its clients will be transferred to La Paz. They are currently serving preventive detention in Palmasola, and will remain in this facility, according to the lawyer.

“It is not appropriate considering that They have home, work, family and more in Santa Cruz. Their social status is within the territory of Santa Cruz, so their transfer would not occur,” he noted.

Besides, Durán considers that the TCP decision does not help the process since all the procedures of the process must be carried out at the headquarters of Government. He adds that the investigation process also benefits because by filing the case in La Paz, the collaboration of the Santa Cruz Prosecutor’s Office will be required.

“Let the case go to La Paz What this will cause is that every investigative act “It has to involve cooperation from the Prosecutor’s Office and this will cause procedural delay,” said Durán.
