After two challenges, first to the prosecutor Sonia Pereira (who led the undercover), then to Mirtha Ortiz, the case was assigned to the prosecutor Myriam Rodríguez, who requested dismissal for Toledo and two other defendants.
On August 22, 2020, the president of Abogados de Luque was prosecuted, following a complaint by Mario Quiroga Báez against him. The complainant’s former sister-in-law, Beatriz Alegre, is also charged.
According to the complaint, Toledo and Alegre asked him for the sum of G. 45 million to reach an out-of-court settlement for a cause of family violence.
THE CASE. Beatriz, one of the accused, had denounced Quiroga’s brother for violence and together with his lawyer, Toledo asked for money to withdraw the complaint. In an audio the defender explains the negotiated. That recording was made with judicial authorization at the request of the Pereira prosecutor.
THERE WAS NO EXTORTION. Prosecutor Rodríguez maintained that “it was concluded that the punishable act (extortion) did not exist, since the exercise of force or the ideal threat, objective requirements to configure the illicit act of extortion, could not be proven.” He indicated that there was an out-of-court agreement in accordance.
Quiroga, for his part, said that there were threats to pay. He argued that “there is enough evidence to continue with the case, but many in the Prosecutor’s Office are friends of Toledo.” He announced that they are going to appeal the request for dismissal.
The hearing is set for March 18.
