The disciplinary court of the Public Bar Association of the Federal Capital sanctioned the lawyer with a fine of 300,000 pesos Gregory Dalbonwhich sponsored Cristina Kirchner and Alberto Fernández, for branding judges and prosecutors as corrupt, pointing out that one of them was “bribeed” by the Jewish community and defiantly stating: “Let them come and we will attend to them.”
The fine was imposed by Chamber III of the disciplinary court, made up of Diego Dedeu, Marcela Micielli, Valeria Pugliese, Patricio Ponferrada and José Martínez Tato.
Dalbón was fined for his expressions referring to the cause of the birthday party of Fabiola Yañez, the president’s wife, held at Quinta de Olivos, when a strict quarantine was in effect due to the coronavirus pandemic, in 2020. President Alberto Fernández and Yañez paid 3 million pesos as compensation for their foul. The amount was donated to the Malbrán Institute. Both the prosecutor and the judge accepted this agreement. As there are resources of lateral issues, pending, appealed in the Court, the case has not yet been closed.
In that case, which was initially filed in the federal courts of Comodoro Py 2002, Dalbón introduced himself as President Fernández’s lawyer and criticized the prosecutor Ramiro Gonzalezwho was initially in charge of the case, to the federal judge Sebastian Casanelloto his colleague Julian Ercolini and the late federal judge Claudio Bonadio.
“If you want to come looking for money, here or you will find it because we are not going to bribe you, is that clear?” he said in reference to prosecutor González, adding: “I know that the Jewish community bribed him.” After insisting on accusing Ramiro González of “coimero”. He also maintained: “I know who are the operators who take him and bring him the money”; “Let a first instance prosecutor come to me to become the boss of the mafia who dares. If they call Alberto Fernández, he will appear, we are at the disposal of the Justice, but we are not going to put a weight on him ”; “In Comodoro Py, either you go with the suitcase or you go with the squeeze and Alberto Fernández does not use the square or the squeeze. Let the prosecutor come to see if he is the bank, half are corrupt.
Regarding Judge Casanello, he stated: “I don’t give a damn that the judge is Casanello. I don’t give a damn about the judges. It doesn’t come or go. I don’t know his face. For my Commodore Py, he is rotten again and within the rot: ition is Casanello…). Let Casanello come, we’ll take care of him”. And of Bonadio he expressed: “I know it, Beraldi knows it [abogado de la vicepresidenta]Christina knows. Bonadio was corrupt, if they want to end up the same…”, and then immediately clarify: “I am not referring to death, I am a Catholic, may Bonadio rest in peace”.
And he also referred to Judge Ercolini. He stated that there are many judges who “work for business.” And he added: “They are thieves, they are corrupt. I have not proven it, that is stupid, because obviously if I had proven it I would be denouncing it, but everyone knows that the federal Justice is handled by twine and neither Cristina nor Alberto are going to put a sope. Here is Dalbon. They have to kill me for something to happen to Alberto”.
Dalbón defended his right to express himself, recalled that he retracted and apologized. The court understood that the lawyer formulated the “serious accusations in violation of the deontological plexus that governs our registration.”
“These unfortunate expressions regarding statements against judicial officials, of facts, by the way not proven, nor denounced by the defendant before the pertinent authorities, have at the head of a lawyer with a recognized media presence, an offensive capacity that places the license plate in a place of concern, and in full violation of the duties of the lawyers, inserted in the chapter of the Code of Ethics of this Association”, said the lawyers.
“The content of such expressions in the aforementioned context denote a manifest insulting spirit and outside the ethical canon sought by the profession and this College in particular, covering the same an entity that transferred the legitimate right to freedom of expression that every person has” they pointed out.
And they imposed a fine of 300,000 pesos “For having infringed fundamental duties inherent to the practice of law.”
