At the conclusion of the hearing of the coercion measure against the currently former members of the National Police accused of killing the spouses Joel Díaz and Elizabeth Muñoz, the lawyer of one of those implicated indicated that the measure of one year of preventive detention was issued against all due to mediated pressure.
Yery Castro, defender of the former private Anthony Castro Pérez, said that although he does not interfere in the decision of Judge Sugeldi Rosario Mena, she should not have issued the same sentence to all the accused since they do not share the same link in the process.
“We regret that the public and the media pressure and morbidity generate the need to issue a decision under the same conditions to all the accused when all do not have the same link with the process,” said the lawyer.
He assured that due to the mask and caps that the policemen were wearing, it has not been possible to determine that they were present at the place where the shots were fired, so criminal responsibility would not be applied to him in a trial.
“Most of the people who are there went to a service, listening to the Police radio, they did not go out on their own and they were all properly uniformed and it has not been possible to determine, with a mask and cap, that any of the they were present exactly where the shots were fired, in that sense there will be no way in a trial to sustain criminal responsibility against them, “he concluded.
It also maintained that Antony Castro did not have his weapon loaded at the time of the shots.
This Friday, Judge Sugeldi Rosario Mena, issued a year of preventive detention, as requested by the Public Ministry, against all those involved, in addition to declaring the case complex.
