Hello dear forum.
I would like to know your opinion on the following fictional case.
Person A (Male) has received a letter from Person B (Male)’s attorney.
There, person A is accused of allegedly threatening person B via calls, Whatsapp messages and that person B was harassed and threatened by person A at his home address.
Person A, on the other hand, did not threaten person B, rather person A reported person B to the police at the time for animal cruelty, drug smuggling and the sale of cocaine and cannabis. Person B doesn’t seem to fit, so Person B twists the facts, presents himself as a victim and now accuses Person A of threatening him. Furthermore, person B has another support from person C (wife), who is his girlfriend. Person C, the woman secretly recorded Person A on her cell phone to get “evidence” to accuse Person A of threatening Person B, which is not the case.
Furthermore, in the past, Person C threatened Person A to shoot him and Person C attacked Person B with a hammer, which Person B would not admit afterwards, since Person B and C are back together are, but person A can testify that because person A was present when person C threatened to kill person A, because person B and C were on the phone with each other and the cell phone speaker was on, further person A can testify that person C hit Person B with the hammer.
Furthermore, Person A and Person B sparred together 2-3 years ago, Person B hit Person A severely in the spleen several times, Person A went to the emergency room, suspecting a ruptured spleen, which was not confirmed in the end was, but the pain was there. And just a few years earlier, Person B had got on Person A’s nerves so psychologically that Person A also ended up in a hospital because the stress made Person A feel numb on one side of his face, and Person B laughed about it.
Now the lawyer demands a 3-digit sum and the total value or the contractual penalty is a sum in the 4-digit range. If Person A does not respond, it will be referred to the District Court.
Now what can person A do about the claims made against person B that are not true? But instead, Person B physically injured Person A and Person C threatened Person A with murder and Person C attacked Person B with a hammer, but this was not followed up.
Can person A apply for legal aid if he is a recipient of citizen benefit?
