It has already been announced that on November 15, at the meeting of the Human Capital Development Council, Minister of Economy Viktors Valainis, Minister of Welfare Uldis Augulis and Minister of Education and Science Anda Čakša conceptually agreed on measures to reduce administrative obstacles to the attraction of labor force from third countries and supported the further progress of the prepared regulatory acts for inter-institutional harmonization and beyond for submission to the Cabinet of Ministers for consideration.

“The purpose of the package of amendments is to help entrepreneurs not to lose productivity due to a lack of working hands. It should be noted in particular that the Ministry of Economy is proposing to increase the control mechanisms for the attraction of citizens of third countries. The prepared amendments to the regulatory acts will reduce the use of uncontrolled and unlisted “employee rental services”, which in turn will promote responsible labor migration in these challenging geopolitical conditions,” says Viktors Valainis, head of the Human Capital Development Council, Minister of Economy.

The purpose of the amendments to the Immigration Law is to limit dishonest employers – foreign labor force inviters, providing the right for the Citizenship and Migration Affairs Department to make a decision on the prohibition of a natural or legal person to invite a foreigner for a period of up to one year. As a result, the number of dishonest applicants for visas and residence permits will be reduced, PMLP will have the right to restrict inviters who do not comply with the requirements of regulatory acts related to the employment of foreigners, as well as the flow of illegal migration to the member states of the Schengen Agreement will be reduced.

Amendments to the regulations of the Cabinet of Ministers no. 225 “Rules on the amount of financial resources required by a foreigner and the determination of the existence of financial resources” stipulates that foreign labor is determined not less than the average monthly gross salary of the workers in the Republic of Latvia in the sector (according to the latest information published by the Central Statistics Office) or determined by the general agreement of the sector the minimum wage if the foreigner receives a visa and the right to employment (LDDK). Consequently, these amendments will prevent the situation when the local labor force is paid significantly less than foreigners, reduce the negative impact of the labor shortage on economic growth, as well as reduce the labor shortage in the sectors with the most vacancies and the greatest labor shortage.

Amendments prepared in cooperation with the Ministry of Welfare to the regulations of the Cabinet of Ministers no. 55 “Rules on the employment of foreigners” provides that the company will be able to attract labor from abroad, if the employer has published an open vacancy in the information system for the registration of unemployed persons and registered vacancies administered by the State Employment Agency, providing full information about the job offer, and has cooperated with the NVA no less than 10 working days in the process of selecting suitable applicants, evaluating the candidates offered by the agency. If the vacancy has not been filled as a result of the selection, then the employer, upon receiving a permit issued by the agency, will have the right to submit an invitation or summons application to the Directorate of Citizenship and Migration Affairs within 30 days.

Along with the amendments to the regulations of the MK no. 552 “Procedure for approval of invitations and drawing up of invitations” will remove unnecessary administrative obstacles in the conditions of initial employment of foreign labor by waiving the requirement to submit a copy of a document confirming education/experience. As a result, the situation in which inviters (employers) artificially lower job groups in order to avoid the requirement to submit copies of documents proving education or three years of experience will be prevented, as well as the risks to Latvia’s reputation related to the transit of employees through Latvia to other European countries will be reduced. , the more appropriate solution was chosen to maintain a disciplinary norm, which requires the inviter to verify the qualifications and suitability of the invited candidates for the work required.

Also, during the meeting, the Human Capital Development Council heard the proposals of the Confederation of Latvian Employers (LDDK) and the Latvian Chamber of Commerce and Industry (LTRK) in the field of improving human capital issues. Both LTRK and LDDK representatives emphasized that a well-thought-out immigration policy is one of the priority issues – if the employer cannot find labor here in Latvia, it is necessary to ensure quick and easy availability of labor from third countries, while controlling security risks. The Human Capital Development Council agreed to discuss the proposals of LDDK and LTRK in more detail in future meetings in order to find the most effective solutions for solving the problems identified by business organizations.
