Latest Ciptaker Omnibus Law Manuscript, 1 Article 4 Missing Paragraph

In addition to the number of pages increased by 375, CNN Indonesia.with also found a number of discrepancies in the substance of the current Omnibus Law manuscript with a total of 1,187 pages.


Article 46 of Law Number 22 Year 2001 regarding Oil and Natural Gas is missing from the text of the Omnibus Law on the Job Creation Law which is already in the hands of the government. That article is no longer contained in the 1,187 page manuscript.

Article containing 4 paragraphs is missing and there is no information that the article in question is deleted.

In fact, in the manuscript of the Omnibus Law Law of Work Copyright 812 pages submitted by the House of Representatives to the government, the article still exists and consists of 4 paragraphs. Here is the sound of Article 46 missing.

Art 46

(1) Supervision of the implementation of the provision and distribution of Oil Fuel and Natural Gas Transport by pipeline shall be carried out by the Regulatory Agency as referred to in Article 8 paragraph (4).

(2) The function of the Regulatory Body as referred to in paragraph (1) shall be to make arrangements so that the availability and distribution of Oil and Gas Fuel as stipulated by the Central Government can be guaranteed throughout the territory of the Unitary State of the Republic of Indonesia as well as to increase domestic utilization of Natural Gas.

(3) The duties of the Regulatory Agency as referred to in paragraph (1) include the regulation and determination of:

a. availability and distribution of fuel oil;
b. national Oil Fuel reserves;
c. utilization of Fuel Oil Transportation and Storage facilities;
d. natural gas transportation tariffs;
e. Natural Gas prices for households and small customers; and
f. operation of Natural Gas transmission and distribution.

(4) The duties of the Regulatory Body as meant in paragraph (1) include the supervisory duties in the fields as meant in paragraph (3).

CNN Indonesia.with also found differences in the placement of the Chapter on National Fiscal Policy relating to taxes and levies.

In the 812-page version of the text, this provision is provided for in Chapter VIA. Its position is inserted between Chapter VI and Chapter VII.

However, in the 1,187 pages of the current version of the government manuscript, the chapter becomes Chapter VIIA. Inserted between Chapter VII and Chapter VIII.

Another difference is also seen in Chapter VIA on National Fiscal Policy relating to Taxes and Fees. Version 812 pages, Chapter VIA is inserted between Chapter VI and Chapter VII.

While the 1,187 page version, CHAPTER VIA changed to CHAPTER VIIA which was inserted between Chapter VII and Chapter VIII.

It is known, the manuscript of the Omnibus Law of the Job Creation Law has changed the number of pages six times. Initially there was a version of 1,208 pages uploaded on the official DPR website. Then there was a 905-page version when it was read out at the DPR Plenary Session on October 5.

Then the new version appeared again, namely 1,052 pages and 1,035 pages. When the DPR submitted the final manuscript to the government on October 14, the Omnibus Law on the Job Creation Law had 812 pages. At that time, the DPR said the manuscript was final.

However, now the manuscript has changed again and has grown to 1,187 pages. The latest text from the government has been received by the Indonesian Ulema Council (MUI) and PP Muhammadiyah. The MUI claimed to have received the latest text of the Omnibus Law on the Job Creation Law, which is 1,187 pages from the State Secretary Pratikno.

Contacted separately, Deputy Chairman of the DPR Legislation Body, Willy Aditya, agreed that there were changes in the text after being held by the government. Changes were made in order to adapt the writing to the state sheet format before it was promulgated.

“What has changed is adjusted to the state sheet issued by the State Secretariat. Underwent an editorial change from a term commonly used by the DPR to be statutory regulations,” Willy said when confirmed by telephone.
