The Plovdiv Court of Appeal upheld the verdict of the Staro Zagora District Court, by which C. S. was sentenced to 16 years of imprisonment for kidnapping, illegal imprisonment, beatings and mistreatment of a woman committed in the context of domestic violence.
The case in the Court of Appeals – Plovdiv was initiated on the complaint of the defense counsel of the defendant C. S. with a request that his sentence be annulled and a new one be issued, by which he would be recognized as innocent. Alternatively, a reduction of the imposed custodial sentence is requested.
The defendant C.S. and the victim M.A. lived together as a family for 20 years and had five children. Gradually, C. S. began to use drugs and the relationship with the woman deteriorated. Frequent scandals between them. He was jealous and often beat her. Because of the beating of the woman, C. S. was convicted three times and was in prison. She left him and moved with the children to live with her mother. Their daughter got sick and had to have an operation.
On July 29, 2021, CH called MA under the pretext that he was going to take people to donate blood for the operated girl. After the two spent two hours in front of the hospital, he admitted that he wanted to get back together and live together. She flatly refused. Then C.S. threatened her with a knife and forced her to get into a taxi. He took her to relatives, where he began to beat her. Then they spent the night in the field. The next day they went to his mother’s house.
His relatives went to work. Left alone, C.S. made her undress. He tied her to the bed and continued to beat her. For hours he kept her chained to the bedroom, covering her mouth with a rag so she wouldn’t scream. He beat her with his fists, burned her with a hot electric soldering iron, both on her body and face. When the relatives returned from work, he untied her. In the morning, while everyone was sleeping, she managed to escape.
The appellate judges consider that the District Court – Stara Zagora completely justly determined the amount of the defendant’s punishment in the presence of aggravating circumstances and reasonably assumed that the goals of the punishment can be fulfilled precisely with imprisonment of 16 years.
The decision of the Appellate Body is not final. It is subject to protest and appeal before the Supreme Court of Cassation.
