Accused were now – due to the pursuit drive – the criminal offenses of illegal car racing, willful drunkenness in traffic and driving without a license, also deliberate.
A first patrol officer testified as a witness that he had initially assumed a drunk driving. This is how the man drove serpentine lines on Raiffeisenstrasse. To prevent worse things from happening, they kept their distance and followed the Twingo with flashing lights and a siren.
In urban areas with more than 100 km / h
The defendant continued to flee despite the loudspeaker announcement and a clear stop signal. The speed in Raiffeisenstrasse was in the “three-digit range” – that is, more than 100 kilometers per hour. In the residential area in Kippenheimweiler, too, the man was driving significantly too fast.
When asked by lawyer Matthias May, who represented the accused in court, the officer admitted that there was no immediate danger to others during the night.
The fleeing driver would certainly not have been able to react accordingly if a critical situation had arisen. The defendant, who now works in Switzerland and is currently registered there, testified on the matter. He described his behavior as “stupidity”. However, since his driver’s license had already been withdrawn due to similar accusations, he reacted so rashly. The defendant’s testimony was essentially what the officer confirmed as a witness. The only thing he couldn’t remember was the speed. Which was partly due to the drugs and partly to the adrenaline due to the situation.
Prosecutor calls for a prison sentence
After the evidence was obtained, the charges in the illegal car racing case were amicably dropped. Drunk driving and driving without a license remained.
Tim Richter, who heads the criminal proceedings at the Lahr district court, assessed the accused’s statements as mitigating the penalty. Lucie Kirstein, the public prosecutor’s representative, saw it that way too. Since the accused has a considerable and above all relevant criminal record for similar offenses, in this case she demanded a prison sentence of three months and three weeks, which should not be suspended on probation.
The defendant had also accepted a penalty warrant for driving without a license in 2020. So there had been no trial in this case. The sentence at the time was three months probation, which has not yet expired. The lawyer now pleaded for a four-month prison sentence, which should be suspended again.
The lawyer considered a ban on reapplying for a driver’s license to be inappropriate. The accused had to pass a medical-psychological test that would amount to a ban. Since the father of a child lives in orderly circumstances and has a regular job, this is appropriate – also because of the clear admission of guilt.
Richter ultimately sentenced the defendant to four months’ imprisonment, which was suspended again, and a nine-month ban from reapplying for a driver’s license. In addition, the convict has to pay 1000 euros to Lahr drug help. Richter stated that the perpetrator must also feel the punishment immediately. But that is the last warning.
Due to the two suspended sentences, a new charge would probably lead to a longer prison sentence.
