Labor inspector sanctioned during confinement: a senior official resigns

Labor Minister Elisabeth Borne accepted the resignation of one of the most senior officials in her ministry, due to a deep disagreement on the way he handled the file ofa labor inspector, sanctioned for being accused of disobeying during confinement, we learned Saturday, September 12, 2020 from the ministry.

The Director General of Labor (DGT), Yves Struillou, tendered his resignation on Friday and Elisabeth Borne accepted it, said a spokesperson, confirming information from Le Monde.

This departure is linked to the management of the Anthony Smith case, this labor inspector stationed in the Marne, who had been laid off in April in full confinement – the Minister of Labor was then Muriel Pénicaud -, then sanctioned in August with an automatic transfer to Seine-et-Marne. This sanction was finally softened on Wednesday, with a transfer to the Meuse, closer to his home.

The Minister and her Director General of Labor converged on the sanction pronounced, however there was deep disagreement on how the case was conducted, the ministry said.

Backpedaling

According to The world, this disagreement concerned in particular the manner in which the disciplinary report which led to the sanction against the labor inspector was drawn up.

For Julien Boeldieu, Elisabeth Borne could no longer accept the inconsistency on the issue of wearing a mask: it was becoming untenable to sanction someone for that, at the time when we impose the wearing of a mask in companies, he argued, calling victory the resignation of Yves Struillou.

The minister, who succeeded Muriel Pénicaud at the beginning of July, did not want to withdraw entirely by completely canceling the sanction, analyzes the trade unionist. She tries to do a sleight of hand by saying that the file is closed, but for us it is not: there remains an automatic transfer which seems unjustified and disproportionate to us, he added.

Since the start of this affair, Anthony Smith has been supported by the CGT, FO, FSU, SUD and CNT unions. July 21, several hundred people gathered in front of the Ministry of Solidarity, at the call of this inter-union. A petition of support launched in mid-April collected nearly 150,000 signatures.

Anthony Smith was sanctioned because he did his job too well, said CGT General Secretary Philippe Martinez at the rally.
