What is breakability, at the heart of the conflict?
Secability is not a new principle at La Poste. It applies every day during the summer period, but also on so-called “low” days – including days when the volume of mail to be delivered is lower than usual – the rest of the year, i.e. Monday and on Tuesday. This organization of work, where unallocated rounds are distributed to letter carriers in addition to their own round, dates from 2012.
“Wild extension” according to the union
In Nanterre Levant, the Sudposte union criticizes the management of the sorting center for not having put an end to the splitting applied during the summer of 2021 and speaks of “wild extension”, imposed without prior consultation of the CSE, yet compulsory before any change in the organization of work. A system put in place to “avoid” recruiting staff, denounces Gaël Quirante, departmental secretary of the Sudposte 92 union.
Blames to certain factors, right of withdrawal
In October, mail carriers who refused to provide the breakable part of their tour would have been sanctioned by a reprimand from the management. The majority of the staff concerned therefore decided, on October 13, 2021, to exercise their right of withdrawal to protest against this situation.
Following this action, the Sudposte union speaks of pressure from the management of La Poste and of twelve dismissal procedures in progress.
Labor inspection report
In a report dated October 2021, viewed in full by News Hauts-de-Seine, the labor inspectorate agrees with the union.
This new mode of organization necessarily implies an increase in the workload of the postmen concerned and constitutes a modification of the working conditions. It could not therefore be put in place without first consulting the competent CHSCT. However, the divisibility applies in fact since the month of September without any consultation having been carried out.
Formal notice
In addition, the report points to the psychosocial risks incurred by the factors concerned. According to the testimonies collected, the employees testify to a great “moral suffering”, which is manifested in particular by “feelings of anguish, anxiety, even depression”.
The labor inspectorate issued a formal notice to La Poste. It enjoins him to carry out an assessment of the workload of the employees and of the psychosocial risks induced by the extension of the divisibility.
A court decision on March 30
The case was brought before the Nanterre Commercial Court on Wednesday February 2, 2022. The court’s decision will be handed down on March 30.
“We want it to be dealt with quickly,” explains Gaël Quirante, who still hopes for the establishment of mediation with the management of the Nanterre Levant sorting center. Contacted by News Hauts-de-Seine, La Poste indicated “not to comment on ongoing legal proceedings”.
