In an extensive request disclosed through the media, the company Hidráulica del Brasil SA (HB), a firm specialized in repair and maintenance of multi-brand heavy machinery, expresses its dissatisfaction with the arbitrary handling of a tender by the Ministry of Public Works and Communications (MOPC).

It specifically refers to the call for national public tender No. 54/2020 for maintenance and repair services of trucks, road equipment and machinery with ID No. 384,208, for a maximum value of G. 71,000,000,000.

It explains that it took the measure of making the complaint public in the absence of a response from the head of the MOPC, to the request for a hearing that was presented by this company on January 13, in order to personally expose the same “serious and malicious irregularities ”.

The abnormalities occurred both in the drafting and publication of the Bidding Terms and Conditions (PBC), as well as in the awards made in the bidding process named above, says the complainant company. He then makes a long account of the events surrounding the controversial tender.

“The countless irregularities committed are born in a PBC that was established with such laxity and inconsistencies that it made it impossible to prepare offers efficiently and allowed the bidder to apply subjective criteria to evaluate and eventually award the tender to the detriment of the principles of equality and transparency that must always take precedence in any public procurement process ”, he mentions.

The central point of the protest lies in the fact that, already in the bid evaluation stage, the MOPC irregularly disqualified HB “with more than subjective, non-existent arguments, which did not even take care to defend in the protest against the award that was raised by HB, currently under study at the DNCP ”.

In return, the awarded companies presented IPS forms with dates after the act of submission of offers. “Violating the most basic principle of equality, the MOPC admitted that the awarded firms present documents requested in the PBC with an issue date after the opening ceremony,” he assures.

After providing a lengthy explanation of its displeasure, the affected company concludes that The MOPC from the beginning has behaved with HB in an arbitrary and selective manner, in an attempt precisely to leave it out of competition and to other firms that are not the previously “chosen” ones.
