Nationwide focus campaign against undeclared work
Last Friday, the financial control for undeclared work (FKS) of the main customs office in Krefeld carried out checks in the hotel and catering trade as part of a nationwide focus campaign so-called performance fraud.
In the area of the main customs office in Krefeld (cities of Krefeld and Mönchengladbach as well as the districts of Neuss and Viersen), 47 customs officers were on duty who checked a total of 149 people who were found working in 32 restaurants. Officials from the immigration offices of the district of Viersen and the city of Krefeld and the Mönchengladbach police were also involved in the operation. A total of eleven people were identified who could not produce a valid work permit. In three of these cases, arrests were made and, after interrogation, the persons were handed over to the responsible foreigners authority, which is now deciding on their further whereabouts and the follow-up measures. This was a Vietnamese, Indian and Georgian citizen. At the beginning of the check, the Vietnamese citizen also identified himself with a Slovenian passport, which after a check turned out to be a forgery. As a result, criminal proceedings were also initiated against the accused for forgery of documents.
In addition, six criminal proceedings were initiated against employers for withholding and embezzling wages. In three cases, criminal proceedings were initiated because of fraud due to the so-called abuse of benefits.
In 14 cases, immediate reporting violations were identified in which the employer had not yet – immediately, as required – reported alleged new employees under social security law.
When inspecting a restaurant in Mönchengladbach, the municipal food control authority was called in due to the hygienic conditions found.
In at least 38 cases, the checks carried out are followed by extensive re-checks in which the employee data collected on site is compared with the payroll and financial accounting of the company and other business documents are checked.
When it comes to combating undeclared work, customs pays particular attention to the hotel and catering industry. Again and again, violations in the most diverse forms of manipulation and inspection are found in these labour-intensive industries with widely varying working hours and volumes.
The successful implementation of the focus test is not least due to the successful cooperation of all authorities involved.
