KPU Sued for Rp. 70.5 Trillion Allegedly Unlawful Acts in Presidential Candidate Registration

General Election Commissions (KPU) was sued for Rp. 70.5 trillion for alleged unlawful acts for accepting registration for presidential and vice presidential candidates Prabowo Subianto and Gibran Rakabuming Raka. KPU Chairman Hasyim Asy’ari said he would attend the trial if summoned.

“If there is a summons for a trial, we will attend the trial,” said Hasyim to journalists in the KPU office yard, Monday (30/10/2023).

He said that until now the KPU had not received the materials for the lawsuit. He said he would comply with the court summons if an official summons was received.

“Yes, later when there is a summons from the court, there is material for the lawsuit, we will study it, right now we don’t know,” he said.

“Later there will be an official summons, a court summons. What the lawsuit is. We don’t know yet,” he added.

Previously, a lecturer named Brian Demas Wicaksono sued the KPU for allegedly violating the law because he accepted the registration of presidential and vice presidential candidates Prabowo Subianto and Gibran Rakabuming Raka. The lawsuit was filed at the Central Jakarta District Court.

“Incidentally, as a plaintiff against the KPU, I am a plaintiff, my background is as a lecturer, academic, I saw that there was an unlawful act committed by the chairman of the KPU. The chairman of the KPU should have held a hearing with the DPR first to make changes to the PKPU,” said Brian Demas to journalists at the Central Jakarta District Court, Jalan Bungur Besar Raya, Central Jakarta, Monday (30/10).

Demas said the KPU should make changes to the PKPU in accordance with the Constitutional Court’s decision regarding the age limit requirements for presidential and vice presidential candidates. According to him, the PKPU changes were not made by the KPU but they still accepted the registration of presidential candidates Prabowo and Gibran.

“But this was not done by the chairman of the KPU, instead he then accepted the registration without changing the PKPU first. Therefore, the registration carried out by vice presidential candidate Gibran Rakabuming Raka did not have a proper legal basis or legal standing because it was not in accordance with what had been regulated “In the PKPU, the terms are only 40 years, there are no other redactions in accordance with the Constitutional Court’s decision,” said Demas.
