Stronghold witness Ganjar-Mahfud called the General Election Commission (KPU) RI published fake minutes regarding the completeness status of candidacy requirements documents Gibran Rakabuming Raka. The KPU then provided clarification.
The witness was named Sunan Diantoro. He was previously the attorney for the reporter of a similar case at the Election Supervisory Body (Bawaslu) and the Election Organizer Honorary Council (DKPP).
“The KPU was also proven to have made fake minutes regarding the nomination of Gibran Rakabuming Raka to become vice presidential candidate. The KPU only published the minutes on October 27 2023, even though the registration stages for presidential and vice presidential candidates in accordance with KPU Regulation Number 19 of 2023 took place on October 19-25 2023 ,” said Sunan Diantoro in the follow-up hearing of the 2024 presidential election dispute at the MKRI, Jakarta, Tuesday (2/4/2024).
From Sunan Diantoro’s statement, the KPU only published the minutes of the event on 27 October 2023, even though the registration stages for presidential and vice presidential candidates in accordance with KPU Regulation Number 19 of 2023 took place on 19-25 October 2023.
“It doesn’t match what happened. This is the minutes of the Prabowo-Gibran event which (registered with the KPU) on October 25. But this minutes was written on Friday, October 27 2023,” said Sunan.
Meanwhile, the Chairman of the Indonesian KPU, Hasyim Asy’ari, said that the minutes of the event would only be published on October 27 2023 because he was waiting for the results of the health examination of the presidential and vice presidential candidates by the Gatot Subroto RSPAD, Jakarta. The results of this medical examination are said to be one of the required documents for registration of presidential and vice presidential candidates, so it is natural that the Indonesian KPU will not immediately publish an official report on the completeness of Prabowo-Gibran’s registration status on October 25 2023.
“So, in the KPU’s view, the logical time to make a registration report is not when the registration is received,” said Hasyim.
However, in the decision of the Election Organizer Honorary Council (DKPP), the KPU was deemed to have committed a violation in this incident. DKPP is of the opinion that the actions of the Indonesian KPU are unusual because they were carried out not in accordance with the principles of administrative law.
In its decision, the DKPP considered that the Indonesian KPU commissioners should publish the official report on the day and date of registration for each presidential and vice presidential candidate, in accordance with the program and schedule for the nomination stages.
“However, the defendants published the minutes not in accordance with the registration time carried out by each prospective candidate pair,” said the decision.
Next, Bawaslu Chairman Rahmat Bagja asked the witness whether Sunan knew and saw the DKPP’s decision regarding Gibran’s candidacy.
“Brother witness, in the decision of the election consideration board, did it state that the process carried out in Gibran’s nomination was carried out in accordance with statutory regulations?” Bagja asked
“Did you know that this was included in the decision?” Suhartoyo also asked.
“Yes,” said Sunan.
“As asked by Bawaslu earlier, you see that the legal considerations of the DKPP decision do not justify the KPU regarding accepting Gibran’s registration. Do you see that or not?” said Suhartoyo.
“Nothing, Prof,” replied Sunan.
