KPPU was summoned regarding the Alleged Cartel, Large Cooking Oil Producer was absent Page all

JAKARTAKOMPAS.com – Investigation of alleged cartels cooking oil continues to be carried out by the Business Competition Supervisory Commission (KPPU). The research will last up to 60 days.

KPPU also continues to explore and look for solid evidence of the alleged cooking oil cartel by summoning a number of associations, producers, distributors, packaging and traders.

KPPU’s Director of Investigation Gopprera Penggabean explained, in the first week of the investigation, starting from April 6-8 2022, KPPU had summoned 9 parties.

Seven parties did not comply with the investigation calls, including four producers namely PT Sinar Alam Permai, PT Nubika Jaya, PT Permata Hijau Sawit, and PT Asianagro Agungjaya.

“For this absence, the KPPU Investigation Team will schedule a recall to see whether the delay in attendance is reasonable or there are indications of efforts to hinder the investigation process,” he said in a written statement, Tuesday (12/4/2022).

In the next investigation process, said Gopprera, the Investigation Team will summon 10 parties consisting of packaging companies, manufacturers, and distributors to explore evidence.

“KPPU asks the parties in the investigation process to cooperate in fulfilling the call to speed up the law enforcement process, so that it can be completed and does not require an extension of the investigation period,” he said.

He explained, in Article 41 of Law No. 5 of 1999, business actors are prohibited from refusing to be examined, refusing to provide information required in the investigation/examination, or obstructing the investigation process.

If violated, he said, the act could be handed over to investigators to get into the investigation stage.

Research time of 60 days

As previously explained, KPPU has entered a period of investigation starting on March 30, 2022.

During the investigation process, KPPU immediately asks for information from the reported parties, witnesses, and experts as well as requests for letters and or documents needed.

Through the investigation process, KPPU suspects that there have been various types of violations in the cooking oil case, namely allegations of price fixing with the same movement of cooking oil prices, allegations of cartels regulating the production and marketing of cooking oil, and allegations of restrictions on the cooking oil market.
