At its regular meeting on December 15, 2021, KPKONPI established a conflict of interest for Ivan Dimitrov, Chairman of the Communications Regulation Commission (term 2018 – 2023). The proceedings against him have started on a signal from an executive body.
It has been established that in the period 2019-2021 Dimitrov has issued 11 orders, which determine additional remuneration for CRC employees, including himself. The salaries were paid together with the salaries according to the lists of names approved by the chairman. The issuance of orders and the approval of the lists of names to them, in which his name also appeared, is the exercise of powers in the private interest. With these actions Dimitrov, as a person holding a high public position, has created a conflict of interest, with which he has secured material benefits in the period 25.01.2019 – 27.10.2021. obligations by which it determines its own additional remuneration. The violation calls into question the objective and impartial performance of professional duties, especially when the private interest is combined with the person holding the highest public office.
Dimitrov was fined BGN 5,000. The state was deprived of the amount of BGN 63,449, representing the material benefit realized from the conflict of interests, as well as the amount of BGN 6,434.34 – the daily remuneration for the days , in which the orders are signed and approved.
KPKONPI adopted a decision establishing a conflict of interest with regard to Victoria Grozeva – Chief Architect of the Municipality of Stara Zagora. Proceedings against her have begun on a signal. In the course of the inspection, evidence was gathered that on 05.06.2020 she, in her capacity as a person holding a high public position, issued an order authorizing the elaboration of a detailed zoning plan (DDP) of an architectural company, whose sole proprietor the owner is her husband. Thanks to this order, Grozeva’s husband received remuneration under an investment research and design contract from a company with which he concluded the contract. In this way, an intangible benefit was realized, expressed in aid and support, and a material benefit – expressed in the receipt of a sum of money, in the private interest of a person related to it. In this case, Grozeva should have resigned from her specific duty. She was fined BGN 5,000.
According to LCONPI, a conflict of interest arises when a person holding a senior public office has a private interest that may affect the impartial and objective performance of his powers or duties. Following the initiation of the proceedings, the Commission shall request and receive the necessary information and documents, and shall issue a reasoned written decision within two months, which may be extended once for up to 30 days. The decisions of KPKONPI for establishing a conflict of interest are not final and are subject to appeal or protest under the APC. The establishment of a conflict of interest with an effective decision is grounds for dismissal, unless otherwise provided by the Constitution. For the persons mentioned above – Ivan Dimitrov and Victoria Grozeva, the adopted decisions of KPKONPI have not entered into force.
