Inactive KPK commissioner Firli Bahuri canceled getting legal assistance from the anti-corruption agency regarding his status as a suspect in extortion against former Minister of Agriculture Syahrul Yasin Limpo (SYL).
“From the results of the discussion, the KPK leadership agreed not to provide legal assistance regarding the investigation into the alleged corruption case which is currently being processed at Polda Metro Jaya,” said Head of KPK News Division Ali Fikri after the press conference announcing the alleged bribery case in Bandung, the KPK’s Red and White Building, Tuesday (28/11) evening.
Ali said that the meeting was attended by the KPK leadership and structural officials involved in the context of the case involving the inactive KPK commissioner, including elements from the KPK Legal Bureau.
He explained that the decision not to provide legal assistance to Firli referred to Government Regulations relating to the Rights, Finances, Position, Protocol and Security Protection of KPK Leaders.
“There are provisions there that legal assistance and security protection are provided in connection with the implementation of the KPK’s duties and authority,” explained Ali.
“The leadership meeting discussed this and concluded that the alleged criminal act currently being processed at Polda Metro Jaya did not comply with the provisions in the Government Regulation in question, so the Corruption Eradication Commission did not provide assistance,” continued the spokesperson with a prosecutor’s background.
Previously, Firli had been named a suspect by Polda Metro Jaya. He was caught in a case of alleged extortion against former Minister of Agriculture Syahrul Yasin Limpo (SYL).
As a result of this status, Firli was temporarily removed from his position as Chairman of the Corruption Eradication Committee and deactivated from his position as commissioner of this anti-corruption agency. As his temporary replacement in the position of Chairman of the Corruption Eradication Committee is commissioner Nawawi Pomolango.
After being appointed as interim chairman of the Corruption Eradication Committee, Nawawi said that his party would again discuss plans to provide legal assistance to Firli. This statement also corrected previous statements from KPK Deputy Chairman Alexander Marwata. In a press conference at KPK headquarters, Alex said that Firli still received legal assistance after becoming a suspect in extortion.
“What is clear is that Mr. Firli is still a KPK employee. Of course, in carrying out his duties and obligations, he is entitled to legal assistance,” said Alex at a press conference at the KPK Building, Thursday (23/11).
In the case of alleged extortion against SYL, Polda Metro Jaya investigators used Article 12 letter e, Article 11 or Article 12B of the Corruption Eradication Law (UU Tipikor) in conjunction with Article 65 paragraph 1 of the Criminal Code. Firli faces life imprisonment.
On Friday this week, Firli is scheduled to be questioned as a suspect. Apart from that, the investigation team from Ditreskrimsus Polda Metro Jaya also scheduled an examination of four other KPK leaders.
In this process, Firli, through his legal team, Ian Iskandar and his friends, registered a pre-trial at the South Jakarta District Court (PN) on Friday, November 24 2023 to question the law enforcement process carried out by Polda Metro Jaya. Firli sued Metro Jaya Police Chief Inspector General Pol Karyoto.
The Pretrial Application has been registered with case number: 129/Pid.Pra/2023/PN JKT.SEL. Case classification is whether the determination of a suspect is valid or not.
The case will be examined and tried by single judge Imelda Herawati. The inaugural trial will be held on Monday, December 11 2023.
