KPAI revealed the latest news regarding the case of three brothers and sisters who embraced Jehovah’s Witnesses in Tarakan, North Kalimantan, who did not go to class three times. Like what?
KPAI Commissioner Retno Listyarti said a joint team consisting of the Inspectorate General of the Ministry of Education and Culture Research and Technology (Intjen Kemendikbud-Ristek), KPAI, and elements of civil society, had monitored Tarakan regarding this case.
Here are the findings:
The finding is that the three students are students at SDN 051 Tarakan City, North Kalimantan. They are brothers and sisters named M (14) grade V SD; Y (13) grade IV SD; and YT (11) second grade elementary school. They did not go to class in the 2018/2019 school year; then the 2019/2020 school year; and the 2020/2021 school year.
The Inspector General of Kemendikbud-Ristek also formed a joint team to directly monitor Tarakan and find solutions. On the first day, the team visited the homes of the three children’s parents to listen to the children’s voices.
Then on the second day, the team carried out supervision to the school (the defendant) to ask for clarification or confirmation of the information the team received from the complainant. Meanwhile, on the third day, the team conducted an FGD or it could also be called a coordination meeting at the Tarakan Mayor’s office to convey the team’s findings as well as find solutions for the best interests of the children.
“Unfortunately, in the FGD, the solutions that emerged from several SKPDs were not in the best interests of the children,” said Retno Listyarti, Saturday (27/11/2021).
Retno said the SKPD should be appreciated because it sided with the interests of the child and the Tarakan City Women’s Empowerment and Child Protection Service (PPPA) had actually provided psychological assistance to the three child victims and their parents.
Currently, the three children have received psychological therapy four times from the psychologist Himpsi Tarakan in collaboration with the PPPA Service. So far, children are always picked up by the PPPA Service when they have to undergo psychological therapy sessions.
Because 3 children did not go to class for 3 years in a row
Retno explained that from the information received by the monitoring team, the three child victims changed their religion in 2018 from Protestant Christianity to Jehovah’s Witnesses. Coincidentally, not going to the first grade was in the 2018/2019 school year, the three children were expelled from school for about 3 months. The reason for not getting the first promotion was that absenteeism did not meet the requirements, there were about 90 days the three children were considered absent without explanation, even though their absence was because they had been expelled from school for 3 months.
“The TUN Court’s decision won the lawsuit on behalf of the three children. The Administrative Court’s decision in the case of not going to class for the first time is already inkrah,” said Retno.
Then in the 2019/2020 school year, the three were again declared not to go to class. As for the reason for not going to the second grade, the religious value of the three children is zero or has no value. This is because the three of them did not receive religious lessons. The school argued that there were no religious teachers for Jehovah’s Witnesses, even though Jehovah’s Witnesses were included in the Christian religious education section by the Ministry of Religion. So the three children should have the right to receive Christian religious education in their schools.
“The TUN Court’s decision at the first level was won by the three children, but the Tarakan City Education Office appealed and won the appeal court. The plaintiff then appealed and the cassation decision has not yet been made. This means that it has not signed up until November 2021,” said Retno.
The case for not going to class for the third time occurred in the 2020/2021 school year. This time the reason the three children did not go to grade was incomplete religious values, while the scores of all other subjects were very good.
The findings of the joint team showed that the three children admitted that they had followed all the learning processes of Christian religious education in their schools. Always do all the assignments given, including the test / exam.
Even the values of knowledge are always high in value. However, during the practice grades, the three children were not willing to sing the spiritual song determined by the teacher because it was against their faith, and asked to change the song according to their faith.
“The case of not going to class for the third time was also sued to the TUN Court, the filing of the new case was carried out in October 2021. Currently, it is still in the trial process,” explained Retno.
