Knock! Bankruptcy Lawsuit Against Bank Capital Boss Danny Nugroho Officially Withdrawn

The lawsuit against controlling shareholder and President Commissioner of PT Bank Capital Indonesia Danny Nugroho has been officially withdrawn. This information was announced by the applicant’s attorney at the Semarang Commercial Court.

The applicant’s attorney, Hari Benarto Sinaga, said that both parties had met and an agreement had been reached. He also stated that the problem had now been resolved so that his party had withdrawn the lawsuit.

“The two parties have met and have found an agreement. The existing problems have been resolved and are now clear. Therefore, we withdraw our application at the Semarang Commercial Court,” said Hari, in a written statement, Wednesday (29/11/2023) .

Previously, David Griffin and Nicholas James Gronow sued Danny Nugroho for bankruptcy at the Semarang Commercial Court. Registration of the bankruptcy lawsuit was carried out on Friday, October 20 2023, and was registered with number 10/Pdt.Sus Bankruptcy/2023/PN.Niaga.Smg.

According to Hari, each party has good intentions. Therefore, it can ultimately produce a good solution for both parties. Representing his client, he also expressed his appreciation to Danny Nugroho who helped resolve this problem with a family approach.

“We, including Mr Danny, feel there is no need to prolong this problem any longer. Now everything has been resolved well,” he said.

Meanwhile, Danny Nugroho’s attorney, Muhammad Aminudin Safutra, also appreciated the plaintiff for withdrawing the application.

“All misunderstandings have been resolved well and we appreciate the process of resolving the problem which is going well,” said Aminudin.

As additional information, Danny Nugroho is known to be the controlling shareholder and President Commissioner of PT Bank Capital Indonesia Tbk (BACA). Quoted from detikNews, the basis for the bankruptcy lawsuit against Danny Nugroho is the debt arising from the share repurchase agreement (repo).

Meanwhile, Danny Nugroho has provided a personal guarantee (PG) to guarantee the obligation to buy back the shares. This is as stated in the Individual Guarantee Deed Number 30 dated 18 June 2019 which was made in the presence of H Teddy Anwar, SH. SpN, Notary, in Central Jakarta.

“That as an effort to recover our client’s receivables, our client needs to take optimal legal steps, including filing a Bankruptcy Lawsuit against Danny Nugroho as guarantor. As for the value of Danny Nugroho’s obligations arising from the guarantee as of August 16 “2023 is CHF 20,257,466 or more than IDR 340 billion,” said Hari, some time ago.
