With the negotiation he achieved in the Council of the Magistracy, the Government is in a position to appoint a dozen judges in the federal courts of Comodoro Py 2002, the most sensitive for officials and former officials of all political colors.
The agreement reached by the representatives of the judges in the Council of the Magistracy, to which the opposition joined, allowed the Government this week to place two chambermaids in the Federal Chamber, the court that functions as the key to confirm or revoke prosecutions of government officials or opponents.
With the votes of the judges and Cambiemos councilors, the Magistracy Council approved, without any vote against and with one abstention, the shortlist that includes the lawyer Roberto Boico, candidate of Kirchnerism, to fill one of the vacancies in the Chamber II of the Federal Chamber. The majority opinion also received the green light for Judge Eduardo Farah to return to that same chamber of the Federal Chamber. Both are government candidates for that strategic court. Will integrate Chamber II of the Chamber with what could leave in minority to Martín Irurzun, the third judge of that court.
Boico is a lawyer for Vice President Cristina Kirchner in the case involving the signing of the memorandum with Iran. Now, the shortlist will be elevated to the Executive Power for Alberto Fernández to choose his candidate from among those proposed. Both the ruling party and the opposition take it for granted that it will be Boico. And Farah, who had transferred to an oral court after releasing Christopher Lopez,return now to the same room of the Chamber.
This agreement allowed the opposition to place its own candidates in other vacant courts such as the Economic Criminal Chamber, two positions in the Labor Chamber, the Federal Civil and Commercial Chamber, in the oral courts of La Plata, Rosario and eventually Mar del Silver.
But there are still other relevant vacancies to be filled in Comodoro Py 2002: they are those left by the judges Rodolfo Canicoba Corral, that he retired; Claudio Bonadio, who passed away; Sergio Torres, appointed in the Buenos Aires Supreme Court, and eventually the vacancy that would remain in the Daniel Rafecas if your candidacy for the Attorney General is successful.
The open competitions for these charges are 433, for the Torres court, which is to resolve the challenges. Diego Arce, Julio Miranda and Leonel Gómez Barbella were in the first three places in the order of merit, which is provisional. The other open competition is 450, destined to cover the Courts of Bonadio and Canicoba Corral, which the jury has yet to join.

They reproach Cambiemos for not having appointed the Procurator when they were in the Government, nor the third judge of the National Electoral Chamber, nor the federal judge with electoral competence in the province of Buenos Aires. That deficiency in Cambiemos was made up for by the Government this year. Those places were occupied in the middle of the pandemic. If the law is approved, it will have only in the Buenos Aires federal courts, the possibility of placing 23 new judges.
The other key vacancies of Comodoro Py 2002 that will be subject to negotiation in 2021 are those of Chamber I of the Federal Chamber currently occupied by Leopoldo Bruglia and Pablo Bertuzzi, transferred there during the Government of Cambiemos. The Court said that both can continue in those positions until the competition is held to fill those vacancies.
The contest called is Contest 461 to fill these two vacancies and registration was opened for candidates to sign up between February 2 and 8, 2021 and on February 26 they will take a written exam. Kirchnerism hastens the process from the Council and believes that in six months it can finish it. This was expressed by official councilors and the president of the body, Judge Alberto Lugones, estimated it.
The negotiation is applied to cover that contest. But the judges in the Council of the Magistracy have already warned that this contest is the problematic one and that it will not be easy to reach an agreement. The ruling party needs 9 votes to name the replacements of Bruglia and Bertuzzi, who will continue in their positions if that does not happen.
The other positions that will be disputed for their coverage in Comodoro Py in 2021 are six vacancies for the federal oral courts, which are those that make oral and public trials against officials and former officials accused of corruption, as well as against other criminals accused of drug trafficking, kidnapping or human trafficking. That 389 contest is advanced and it remains to resolve the challenges to see how the order in which the candidates are left is. There are six vacancies and for now the provisional order of merit is made up of Agustina Rodríguez, Luis Arnaudo, Nicolás Schiabo, Ignacio Labadens, Roberto Boico (already approved for the Federal Chamber), Marcelo Peluzzi and Ivana Quinteros, among others.
The rules of the game in the council of the magistracy in 2021 will be different from this rapprochement between the bloc of judges, Kirchnerism and the opposition councilors. The arrival of Marías implies the first landing of a man belonging to Horacio Rodríguez Larreta in the Council of the Magistracy. Carlos Matterson is linked to Daniel Angelici, judicial manager in the city and in federal Justice. When the firm Cronopios, from Angelici, took over the Villa Allende bingo hall, in Córdoba, Matterson appeared as their representative. Angelici has terminals everywhere: in Cambiemos, but it also has a direct channel with albertism through Juan Manuel Olmos, Alberto Fernández’s legal advisor with whom they share ancestry in the Buenos Aires Justice.
While Cristina Kirchner faces the Court and demands changes in the highest court, the judges and the opposition agree with the Government at the level of the Council of the Magistracy, in conversations that pre-announce new agreements with new players.
