King of Gambas 2 Restaurant Fined and Closed for Multiple Hygiene Violations

The punishment is salty. The King of Gambas 2 restaurant, located in the Pont de Pierre shopping center in Garges-lès-Gonesse, has just been fined 6,000 euros by the administration for “breaches of the hygiene rules relating to the establishment, food and staff. A decision which follows two series of checks carried out in the summer of 2022 by the departmental directorate for the protection of populations (DDPP 95) within the establishment specializing in woks, grills, Asian ready meals and all-you-can-eat buffet formulas .

With the key, two consecutive administrative closures. The first in June of last year, lasting three weeks. “During this period, the restaurant was completely cleaned, the professional received training and checks had of course taken place by our services before the reopening”, explained Vanessa Hummel-Fourrat, director of the DDPP 95.

Food poisoning reported by consumers

However, less than two months later, its agents were called to go on site again, this time at the request of the regional health agency (ARS) to which customers had reported their food poisoning, fortunately Without gravity. The services of the prefecture then made unappealing discoveries.

“Product storage temperature problems favoring the appearance of bacteria, bins with stagnant water, black frying oil or even rodent droppings on the ground”, specified the head of the DDPP. To this were also added problems of traceability of the meat served in the dishes or a lack of mandatory information on the presence of allergens.

For this recidivism, the sanction was then immediate with a so-called “emergency” closure of the restaurant. A relatively rare procedure, implying that hygiene is not controlled and that there is a significant risk. Last year, the DDPP counted about fifteen, out of the 45 restaurants or food businesses in Val-d’Oise forced into administrative closure of one kind or another.

In 2023, no less than twenty establishments have already been targeted. All are listed on the prefecture’s website and published on social networks, the prefect of Val-d’Oise assuming to practice “name and shame”, i.e. the principle of “naming and shaming” offenders. Sometimes with serious consequences for these merchants and companies.

An agreement between the different parties

This was not, however, a definitive measure for the establishment of Garges. The King of Prawns 2 was able to reopen after this second period of closure and the green light from the DDPP. For the alleged facts, however, he exposed himself to potential criminal sanctions, in addition to administrative sanctions. But an agreement could be reached between the two parties, “with the agreement of the Pontoise public prosecutor’s office”, making it possible to avoid the court.

Indeed, these 6,000 euros constitute a “transactional fine”, ie a legal possibility for the administration to compromise in certain cases. The amount is determined taking into account the commitments made by the offender, lower than the maximum amount of the financial penalty incurred. If the author agrees to pay the proposed sum, the public action is extinguished. This is the case here for the king of prawns. The latter could not be reached.
