Adopted by the Social Affairs Committee on the night of Wednesday September 19 to Thursday September 20, the bill for full employment will be examined from this Monday in public session.
“Network of integration and employment actors”
The text adopted in committee returns to the symbolic question of the name of the future public employment service. Contrary to the Senate, the deputies rename Pôle emploi to “France Travail operator”. The “France Travail network”, which designated all the actors in the first version of the text, has been renamed “network of integration and employment actors”. The “France Travail” territorial committees are renamed “integration and employment committees”.
Removal of 15 to 20 hours of weekly activities
Another important reversal compared to the version adopted by the senators concerns the deletion of the mention of 15 to 20 hours of weekly activities by recipients of active solidarity income, which had been included by the senators. The Commission also removed the principle according to which removal from the list of RSA beneficiaries had to be linked to removal from the lists of job seekers and vice versa. On the other hand, the principle of a “minimum share of random control of job seekers” was adopted for the entire network.
No automatic registration of young people at Pôle emploi outside the job search
The deputies also retained some proposals for amendments from associations of elected officials or stakeholders (read our article of 09/14). Among them, that of the National Union of Local Missions which demanded to exclude from automatic registration at Pôle emploi young people followed in local mission who are not looking for a job, with the support of elected officials from the right as well as from LEFT.
Local committees: co-presidency open to any community
On the aspect of governance and as announced by the Minister of Labor Olivier Dussopt (read our article of 19/09), elected officials from the municipal bloc will be better represented within the various territorial committees of France Travail. Thus, according to the text, the latter will welcome representatives of municipalities and groups of local authorities designated by the departmental association representing municipalities and intermunicipalities.
The text provides that the State representative in the region fixes the perimeters of the local committees on the proposal of the regional and departmental committees. It is also he, and not the prefect of the department (as planned by the Senate), who must designate the co-president, after consulting the representatives of the communities that are members of the local committee. This co-presidency would be open to different types of communities. According to the explanatory memorandum of the rapporteur Paul Christophe, the idea behind this amendment is that a local body could, for example, be chaired by a region “if a major project to set up a factory emerges”, in the department ” if it involves caring for people in difficulty” or to an EPCI “if a new activity zone is established” or in the case of revitalization of a city center.
Regulation of nursery openings
Regarding early childhood, the developments in the text are important. At the initiative of the rapporteur Christine Le Nabour, it is the municipalities with 3,500 and not 10,000 inhabitants that will have to develop and deploy a multi-year plan for maintaining and developing the childcare offer for young children. Exemptions are, however, provided for by the text in the event of a global territorial agreement already concluded with a family allowance fund.
The terms of intervention of the departmental family services committee in the event that an organizing authority fails to exercise jurisdiction, largely removed by the Senate, have been reinstated but in a softened version. Finally, a long government amendment was adopted aimed in particular at clarifying the roles of everyone in the regulation of young child care establishments, both in terms of their opening authorizations and in their control.
