KAS CEO: No EU country sets a minimum price for alcohol, the CJEU has ruled against it

The head of KAS recalled that a few years ago the Court of Justice of the European Union (CJEU) found that the introduction minimum price for alcohol which would violate the provisions of the Treaty on the Functioning of the European Union.

– Referring to the introduction of a minimum price for each unit of ethanol in Poland, it should be noted that no member state in the European Union applies such a regulatory mechanism – said Marcin Łoboda, answering questions in the Sejm.

Minimum alcohol price?

– In addition, it is worth noting the judgment of the Court of Justice of the European Union on 23 December 2015 in case C333/14, which was a preliminary reference, which took a position on the minimum price for alcohol. The Court has clearly stated that Articles 34 and 36 of the Treaty on the Functioning of the European Union must be interpreted in such a way as to prevent a Member State from opting for provisions such as those in issue to the goal of protecting people’s health. and life by increasing the price of alcohol consumption. And he took into account a measure such as an increase in tax, which could be less of a restriction on trade and competition within the European Union – explained the head of the National Tax Administration.

As he emphasized, he agrees that alcohol consumption should be limited, especially among young people up to 18 years of age, but also in society as a whole, but should to achieve this through a tax rate increase plan.

There will be big changes

Deputy Minister of Health Wojciech Konieczny presented the ministry’s plans in the field reducing the availability of alcohol for the Poles. The ministry wants to introduce the minimum price for a gram of alcohol or increase the excise duty. Discussions are ongoing with the Ministry of Finance regarding this issue.

The rules regarding the availability of alcohol and the ability to advertise it will also change. The Ministry of Health wants to ban the sale of alcohol in non-liquid form. The packaging is to be changed so that it is not attractive and does not suggest something that is not in the product. The ministry also wants to ban the sale of alcohol online and introduce a requirement that these drinks in packages of up to 300 ml must be made of metal or glass. Penalties for breaking the rules on the illegal promotion of alcohol must also be tightened. In addition, the project is preparing to ban the sale of alcohol at gas stations between 22:00 and 06:00.
