Kadakkal (Kollam) Case: Man Re-Arrested After 9 Years – Seeking Justice and Compensation

Kadakkal (Kollam) ∙ The person who was sentenced by the High Court was re-arrested after 9 years in the same case and sent to jail. Akhil Ashok (42) had to spend 4 days in jail again at his house on the hill of Kadaikal. Akhil is now looking for an answer to the question of whose side is at fault.

How it happened: In 2004, the Varkala police filed a case against Akhil as the first accused and his mother Salila as the second accused following a complaint filed by his father Ashokan in 2004. He was living in Varkala then. In 2010, the Varkala Magistrate Court sentenced him to 3 months imprisonment and a fine of Rs 5000. An appeal to the district court challenging the verdict was dismissed. The sentence was commuted on appeal to the High Court. In 2014, he was sentenced to a fine of Rs 20,000 and to remain in court from morning till the afternoon. He paid the money in Varkala First Class Court and served the punishment prescribed by the High Court.

A police team came from Varkala on the 10th in the afternoon in search of Akhil, who is looking for a job as a manager at a bar hotel in Kadakkal. The reason behind the arrest was that he had drowned after being sentenced. Akhil’s mother Salila was not well and was not arrested. Akhil was produced in the Varkala court. Akhil says the magistrate asked if he knew about the case. Even though he said he was punished, the court did not take it seriously. As it was a convicted case, Akhil was shifted to Poojappura Central Jail.

Akhil’s relatives contacted the Varkala court and police and searched for old records of the case. The evidence and documents obtained were produced in the Varkala court. Then last day at 4.30 pm, Akhil was released by court order. Akhil’s family was severely affected by the arrest of Akhil despite serving his sentence.

Akhil got married in 2014 after he was released from the chains related to the case. Then settled in a house in Kadakkal. He has a wife and two children. Akhil decided to approach the High Court and the Human Rights Commission seeking compensation against the action. At the same time, the Varkala police said that because there was a court warrant against Akhil, he was arrested and produced before the court.
