Last Thursday, the Collegio di Garanzia dello Sport issued the operative part of the decision with which it accepted Juventus’ appeal on the -15 and referred it to the Federal Court of Appeal. The Code now provides for a deadline of thirty days for the filing of the motivation, but it is decidedly probable that this will happen in a shorter time. The motivations will illustrate the terms of acceptance of the black and white appeal, also enunciating the principle which the CFA will have to comply with in the referral judgement. The Court itself, in different compositions, will have to move within these narrow margins, from which it will be possible to understand what the fate of this complex procedure will be. In the few lines of the device, however, there is already some indication through which it is possible to imagine the content of the motivations.
Judgment Board, the indications
There is the condemnation of Agnelli, Paratici, Cherubini and Arrivabene; there is the acceptance of the appeal of Nedved and other figures, as well as of Juventus itself; there are references to the need for the CFA to determine the causal contribution of the individual directors, provides adequate reasons and draws the “possible” consequences for the sanction to be imposed on the Juventus club. By joining these points, as in a puzzle game, we can derive some considerations. The focus of the proceeding, in the first place, is given by the conduct of Juventus managerswhose convictions are largely confirmed, and not from the capital gains themselves.
