The words of Spadafora and Gravina are clear and leave little room for interpretation. “The protocol is fine and must be applied rigorously”, said the Minister for Sport, even though he would have preferred a shared solution on the matter. Napoli claims to have been stopped by the ASL, when he was about to leave for Turin and present himself at the Allianz Stadium to face Juventus. Local health authorities, as confirmed by Spadafora and Gravina, cannot bypass the protocol validated by the CTS and have the power to intervene only in serious cases. The latter concern, for example, situations in which there are clogged intensive care or outbreaks. Nothing to do with the positivity of Zielinski and Elmas, an absolutely ordinary circumstance that allowed them to play. In similar conditions, Milan, Turin and Atalanta took the field regularly.

The other track undertaken by sports justice is the investigation opened by the Federal Prosecutor on possible violations in the management of positivity by Napoli. The investigation concerns the so-called bubble that would not have been implemented for the players and the entire team group: the doubt relates to the fiduciary isolation that took place at home and not in an agreed structure, as required by the protocol. Also in this case the ASL can give permission to spend the quarantine in one’s home, indicating the safety regulations.

On what happened, the De Laurentiis club is essentially turning the responsibility to the ASL and it is not excluded that it will seek compensation for damages in the event that it is punished. Violation of the protocol can lead to penalties ranging from a fine, to a penalty of one or more points. Penalization possible even without the 3-0, the two things travel separately. With the defeat at the table and the consequent appeal of De Laurentiis, it would go to the second degree of judgment, the Federal Court of Appeal, possibly to the third, the Sports Guarantee College. The next step would be administrative justice, the Tar. The Sports Judge Gerardo Mastrandrea took time to express himself on what happened, asking for an additional investigation to ascertain the dynamics relating to the interaction between Napoli and the two ASLs. The verdict of the match never starts, it could come between the end of this week and the beginning of the next.
