[Mise à jour le mardi 21 avril 2020 à  15h07] Originally scheduled for April 21, the decision of the Versailles Court of Appeal will be released on April 24. Justice will have to rule on the lifting or not of the limitation of the products delivered by Amazon. This new judicial calendar comes at a time when the new risk assessment for all the distribution centers is currently being finalized. Amazon said that any decision to extend the temporary suspension of activity of its distribution centers in France would be subject to prior consultation with employee representatives. To be continued.

Small earthquake in the French e-commerce world while the confinement has recently been extended by a month. “This week, we will ask the employees of our distribution centers to stay at home.” On the Amazon France Twitter account, the announcement is official on Tuesday, April 15. The e-commerce giant will close its distribution centers following the decision of the judicial court of Nanterre, taken the day before. Justice has indeed summoned the behemoth of e-commerce to reduce its activity to the reception and shipment of food, medical and hygiene products. “Considering the complexity inherent in our logistics activities and the fine of one million euros per infraction imposed by the court, the risk of contravening the decision was too high”, justifies the French subsidiary of the international e-commerce site . Note, the products delivered by the companies directly, and not by Amazon, may continue to be.

During the CSE Central meeting held on the afternoon of April 15, the CFDT Amazon France Logistique leaked some information on social networks. The union communicated on the total assumption of responsibility of partial unemployment by Amazon until April 20 inclusive, including for the temporary workers (increase for the night work, substitute, premiums T3). In a publication by the union on the evening of April 15, we learn that the logistics sites of Montélimar, Lauwin-Planque, Sevrey, Boves, Saran and Brétigny-sur-Orge, were to cease their activity on April 16 at 10 a.m.

According to the union, the reception and dispatch services are affected by the partial unemployment measures. Only maintenance, IT, management and safety services would be present in the distribution centers. The CFDT adds that Amazon employees who have enjoyed their right of withdrawal do not need to renew it in the context of partial unemployment declared by the management: they will be paid during these 5 days to the tune of 100% in the same way than their colleagues.

In its series of tweets, Amazon did not provide more details. Bitter, the commercial site recalled having set up temperature controls, distributed more than 1.5 million masks, more than 27,000 liters of hydroalcoholic gel, more than 127,000 packs of disinfectant wipes and reinforced social distancing, since the beginning of confinement, a month ago.

In an interview published by Le Parisien in the evening of April 16, the director general of Amazon France, Frédéric Duval, confirmed that the activity of Amazon France would not be completely stopped. If, as expected, third-party sellers will still continue to ship their products to customers via La Poste in particular, Amazon France will rely on the international network of distribution centers. “Our global warehouses will serve our French customers,” said the managing director. Earlier in the day of the 16th, Frédéric Duval, affirmed to several media being unable to specify a date for the reopening of the distribution centers. He also reiterated that Amazon France would appeal the decision of the court of justice of Nanterre: “We took the decision to close because the judgment of the court of justice puts us in a situation of ambiguity and too important risks And indeed, before us, we have the need to have a judgment of appeal which must arrive but I do not have the date currently. ”

In a press release dated April 19, Amazon announced that it will extend the temporary closure of its French distribution centers until Wednesday, April 22, inclusive. “We remain perplexed by the decision of the Nanterre court made last week and we look forward to hearing our appeal. We are temporarily suspending the activity of our French distribution centers,” said Amazon France. In the meantime, the 10,000 employees and temporary workers from the six distribution centers are invited to stay at home for two more days. If the e-commerce giant has not undertaken partial unemployment, employees will be paid in full, said Amazon France.
