Justice. Sexual assault: the victim accuses him of putting a hand on his buttocks

The police spotted a guy coming out of Wilson Park in Thionville with a bottle of vodka in his hand and a stick in the other. A priori, an argument had just broken out. The 35-year-old is no stranger to them. He has twenty-two records in the register for cases of drugs, concealment and other violence.

That evening, September 2, 2018, he had been drinking. And he ran into two women in the park. One of them filed a complaint for sexual assault. She accuses him of having put his hand on her buttocks. She immediately warned her boyfriend who had found them in stride.

Closed prison

The man in question denied everything while in police custody. And he continued before the Thionville criminal court. The thirty-something, bald, strong, tells that the small group tried to steal his keys to leave with his car. He grabbed a stick to defend himself. His statements are confused. The victim is not the only one lying, according to him. The police too.

The young woman was present at the hearing. She maintains her version and explains that he has come to annoy her. She may have moved away, her attacker approached and caressed her. She does not claim compensation but she is a civil party in support of the prosecution’s accusations. The deputy public prosecutor in turn cites the rather worrying psychiatric expertise of the defendant, visibly little inclined to frustration.

The court follows the requisitions and sentences him to six months in prison. The magistrates also order its registration in the computerized file of perpetrators of sexual offenses.
